Bail Act 1977
Bail Amendment Regulations 2016
The Governor in Council makes the following Regulations:

1 Objective
The objective of these Regulations is to amend
the Bail Regulations 2012 to update certain
prescribed forms to reflect amendments made to
the Bail Act 1977.
2 Authorising provision
These Regulations are made under section 33 of
the Bail Act 1977.
3 Commencement
These Regulations come into operation on 2 May
2016.
4 Form 2A amended
(1) In Form 2A of the Bail Regulations 20121 , for
"12 months imprisonment" substitute "2 years
imprisonment".

(2) In Form 2A of the Bail Regulations 2012, after
"This offence does not apply to conditions about
bail support services." insert "This offence does
not apply to children.".
5 Form 3 amended
(1) In Form 3 of the Bail Regulations 2012, after
"* with an indictable offence alleged to have been
committed while he or she was at large awaiting
trial for another indictable offence;" insert—
"* with a serious offence and the accused, as
an adult, has within the preceding 5 years
been convicted or found guilty of an offence
against section 30(1) of the Bail Act 1977;".
(2) In Form 3 of the Bail Regulations 2012, before
"* with an offence against the Bail Act 1977"
insert—
"* with an indictable offence that is alleged to
have been committed while the accused is
the subject of a supervision order, or interim
supervision order, within the meaning of the
Serious Sex Offenders (Detention and
Supervision) Act 2009;
* with an indictable offence, and the accused,
at any time during the proceeding with
respect to bail, is the subject of a supervision
order, or interim supervision order, within
the meaning of the Serious Sex Offenders
(Detention and Supervision) Act 2009;".
