DETERMINATION OF FISHING CAPACITY Fisheries Management Act 1991 S ubs ection 17(6 )( aa ) Eastern Tuna and Billfish Fishery Management Plan 2010 Subsection 3.2(2) 2013 EASTERN TUNA AND BILLFISH FISHERY OVERCATCH AND UNDERCATCH DETERMINATION The AUSTRALIAN FISHERIES MANAGEMENT AUTHORITY makes the following Determination pursuant to sub s ection 17(6 )( aa ) of the Fisheries Management Act 1991 under subsection 3.2(2) of the Eastern Tuna and Billfish Fishery Management Plan 2010 . Dated: 26 February 2013 The Common Seal of the Australian Fisheries Management Authority was affixed in accordance with a resolution of the Commission Ryan Murphy Executive Secretary Australian Fisheries Management Authority Citation 1. This Determination may be cited as the 2013 Eastern Tuna and Billfish Fishery Overcatch and Undercatch Determination . Commencement 2. This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments. Cessation 3. This Determination ceases as if it were revoked on 1 March 2014 unless earlier revoked. Interpretation 4. T erm s us ed in this Determination that are defined for the purposes of the Eastern Tuna and Billfish Fishery Plan 2010 (the Plan) have the same mea nings in this Determination as they have in that Plan. Notes : 1. Terms defined in the Fisheries Management Act 1991 have the same meanings in this Determination. Determination of overcatch and undercatch 5. The determined percentage and determined weight, for section 4.5 of the Plan (Obligations relating to overcatch ), and the determined percentage for section 4.6 of the Plan (Obligations relating to undercatch ) for each quota species for the fishing s eason commencing on 1 March 2013 and ending on 28 February 2014 are: Quota Species Determined Percentage ( Overcatch – s4.5) Determined Percentage ( Undercatch – s4.6) Determined weight (s4.5) Albacore Tuna 10% 10% 2,000 Kg Bigeye Tuna 10% 10% 2,000 Kg Broadbill Swordfish 10% 10% 2,000 Kg Striped Marlin 10% 10% 2,000 Kg Yellowfin Tuna 10% 10% 2,000 Kg
