No. 8/2016 Fisheries Act 1995 Fisheries (Fees, Royalties and Levies) Amendment Regulations 2016 The Governor in Council makes the following Regulations: Dated: 1 March 2016 Responsible Minister: JAALA PULFORD Minister for Agriculture ANDREW ROBINSON Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Fisheries (Fees, Royalties and Levies) Regulations 2008— (a) to amend the levies for commercial fishery licences and individual quota units; and (b) to make other miscellaneous amendments. 2 Authorising provisions These Regulations are made under sections 151A and 153 of the Fisheries Act 1995. 3 Commencement These Regulations come into operation on 1 April 2016. -- 2 of 12 -- Fisheries (Fees, Royalties and Levies) Amendment Regulations 2016 S.R. No. 8/2016 Authorised by the Chief Parliamentary Counsel 2 4 Principal Regulations In these Regulations, the Fisheries (Fees, Royalties and Levies) Regulations 20081 are called the Principal Regulations. 5 Levies on access licences (1) In regulation 17(3) of the Principal Regulations, for "3 licensing years preceding the licencing" substitute "3 financial years preceding the licensing". (2) Regulation 17(4) of the Principal Regulations is revoked. 6 Levies on fish receiver licences Regulation 18(3) of the Principal Regulations is revoked. 7 Levies on aquaculture licences (1) In regulation 19(3) of the Principal Regulations, for "3 licensing years preceding the licencing" substitute "3 financial years preceding the licensing". (2) Regulation 19(4) of the Principal Regulations is revoked. 8 Levies on individual quota units Regulation 20(3) of the Principal Regulations is revoked. 9 Research levy for Fisheries Research and Development Corporation In regulation 20A(2) of the Principal Regulations, in the definition of GVPf, for "licensing" (where twice occurring) substitute "financial". -- 3 of 12 -- Fisheries (Fees, Royalties and Levies) Amendment Regulations 2016 S.R. No. 8/2016 Authorised by the Chief Parliamentary Counsel 3 10 Reduction or waiver of levies (1) In regulation 23B(1) of the Principal Regulations omit "that is payable".
