No. 148/2016 Planning and Environment Act 1987 Planning and Environment Amendment (Prescribed Class of Amendment) Regulations 2016 The Governor in Council makes the following Regulations: Dated: 13 December 2016 Responsible Minister: RICHARD WYNNE Minister for Planning ANDREW ROBINSON Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Planning and Environment Regulations 2015 to prescribe an additional class of amendment for the purposes of section 20A of the Planning and Environment Act 1987. 2 Authorising provision These Regulations are made under section 202 of the Planning and Environment Act 1987. 3 Commencement These Regulations come into operation on 15 December 2016. -- 2 of 4 -- Planning and Environment Amendment (Prescribed Class of Amendment) Regulations 2016 S.R. No. 148/2016 2 Authorised by the Chief Parliamentary Counsel 4 Prescribed class of amendment (1) After regulation 8(1)(p) of the Planning and Environment Regulations 20151 insert— "(pa) an amendment to a planning scheme to incorporate an infrastructure contributions plan prepared in accordance with Part 3AB of the Act if— (i) the purpose of the infrastructure contributions plan is to fund the provision of works, services or facilities identified in a precinct structure plan or strategic plan and plan preparation costs within the meaning of Part 3AB of the Act; and (ii) an amendment to the planning scheme to incorporate the precinct structure plan or strategic plan (as the case requires) has been approved; and (iii) the infrastructure contributions plan imposes an infrastructure levy consisting solely of one or more standard levy rates for land in the area to which the precinct structure plan or strategic plan applies (as the case requires); and".
