No. 38/2016 Sentencing Act 1991 Sentencing Amendment Regulations 2016 The Governor in Council makes the following Regulations: Dated: 3 May 2016 Responsible Minister: MARTIN PAKULA Attorney-General ANDREW ROBINSON Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Sentencing Regulations 2011 to prescribe time periods for the purposes of Part 8 of the Sentencing Act 1991. 2 Authorising provision These Regulations are made under section 116 of the Sentencing Act 1991. -- 2 of 4 -- Sentencing Amendment Regulations 2016 S.R. No. 38/2016 Authorised by the Chief Parliamentary Counsel 2 3 New Part 9 inserted After Part 8 of the Sentencing Regulations 20111 insert— "Part 9—Historical homosexual convictions 41 Prescribed period after which a conviction becomes an expunged conviction For the purposes of section 105I(3) of the Act, the prescribed period is 42 days. 42 Prescribed notification period For the purposes of section 105K(1) of the Act, the prescribed period is 14 days. 43 Prescribed period for data controllers to take action For the purposes of section 105K(2) of the Act, the prescribed period is 28 days.". ═══════════════ -- 3 of 4 -- Endnotes Sentencing Amendment Regulations 2016 S.R.
