No. 137/2015 Crimes Act 1958 Crimes (Child Pornography) Regulations 2015 The Governor in Council makes the following Regulations: Dated: 24 November 2015 Responsible Minister: MARTIN PAKULA Attorney-General ANDREW ROBINSON Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe matters required to give effect to certain provisions of the Crimes Act 1958 relating to child pornography. 2 Authorising provisions These Regulations are made under sections 67A and 70AAAB of the Crimes Act 1958. 3 Commencement These Regulations come into operation on 1 December 2015. 4 Definitions In these Regulations— Victoria Police has the same meaning as in the Victoria Police Act 2013. -- 2 of 3 -- Crimes (Child Pornography) Regulations 2015 S.R. No. 137/2015 2 Authorised by the Chief Parliamentary Counsel 5 Authorised classifier For the purposes of the definition of authorised classifier in section 67A of the Crimes Act 1958, a prescribed class of person is members of Victoria Police personnel who have undertaken training conducted by Victoria Police in the examination of random samples of seized material and the certification of findings as to the nature and content of the samples. 6 Relevant industry regulatory authority For the purposes of section 70AAAB(5)(b) of the Crimes Act 1958, the body that is prescribed to be a relevant industry regulatory authority is the Office of the Children's e-Safety Commissioner, being the office administered by the Commissioner within the meaning of the Enhancing Online Safety for Children Act 2015 of the Commonwealth. ═══════════════ -- 3 of 3 --
