No. 100/2015 Infringements Act 2006 Infringements (General) Further Amendment Regulations 2015 The Governor in Council makes the following Regulations: Dated: 1 September 2015 Responsible Minister: MARTIN PAKULA Attorney-General MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Infringements (General) Regulations 2006— (a) to prescribe certain infringement offences under the Electricity Safety Act 1998, the Liquor Control Reform Act 1998, the Marine Safety Act 2010, the Plant Biosecurity Act 2010, the Port Management Act 1995, the Road Safety Act 1986, the Tobacco Act 1987, and the Transport (Compliance and Miscellaneous) Act 1983 as lodgeable infringement offences for the purpose of enforcement under the Infringements Act 2006; and (b) to revoke certain infringement offences. -- 2 of 8 -- Infringements (General) Further Amendment Regulations 2015 S.R. No. 100/2015 2 Authorised by the Chief Parliamentary Counsel 2 Authorising provision These Regulations are made under section 168 of the Infringements Act 2006. 3 Commencement These Regulations come into operation on 1 September 2015. 4 Principal Regulations In these Regulations, the Infringements (General) Regulations 20061 are called the Principal Regulations. 5 Item 5.2 of Schedule 3 revoked—Gambling Regulation Act 2003 Item 5.2 of Schedule 3 to the Principal Regulations is revoked. 6 Schedule 3 amended—Liquor Control Reform Act 1998 After item 7.5 of Schedule 3 to the Principal Regulations insert— "7.6 Regulation 4(1) of the Liquor Control Reform (Prohibition of Supply of Powdered Alcohol) Regulations 2015.". 7 Schedule 3 amended—Plant Biosecurity Act 2010 (1) Before item 8AA.1 of Schedule 3 to the Principal Regulations insert— "8AA.1AA Section 8(1), 8(1A), 8(1B) if the offence involves relevant prescribed material within the meaning of Schedule 4 to the Plant Biosecurity Regulations 2012.". (2) In item 8AA.1 of Schedule 3 to the Principal Regulations, after "35(4)," insert "38(2),". -- 3 of 8 -- Infringements (General) Further Amendment Regulations 2015 S.R. No. 100/2015 3 Authorised by the Chief Parliamentary Counsel 8 Schedule 3 amended—Road Safety Act 1986 In item 9A.11 of Schedule 3 to the Principal Regulations, for "Regulation 35" substitute "Regulations 17A and 35". 9 Schedule 3 amended—Summary Offences Act 1966 In item 10AA.1 of Schedule 3 to the Principal Regulations omit "9(1)(c),". 10 Schedule 3 amended—Tobacco Act 1987 (1) For item 10A.1 of Schedule 3 to the Principal Regulations substitute— "10A.1 Sections 5A(1), 5B(1), 5C(1), 5D(1), 5E(1), 5F(1), 5G(1), 5H(1), 5K(1), 5N(1), 5R(1), 5RA(1), 5RA(4), 5RB(1), 5RB(2), 5RB(5), 5RC(1), 5RC(3), 5RD(1), 5RD(2), 5RD(5), 5RE(1), 5RE(4), 5RF(1), 5RF(4), 5RG(1), 5RG(4), 5RH(1), 5RH(4), 5RI(1), 5RI(4) and 5S.". (2) After item 10A.1 of Schedule 3 to the Principal Regulations insert— "10A.2 Sections 6(2AA), 6(2A), 6(2B), 12(1), 12(2), 12(3), 13(1), 13A(1), 13A(2), 14, 15C(1), 15C(3), 15F(1), 15G(1), 15H(1), 15I(1), 15J, 15L(1), 15L(2), 15S(1), 15ZB and 36C(3).". 11 Schedule 3 amended—Transport (Compliance and Miscellaneous) Act 1983 (1) In item 11.2 of Schedule 3 to the Principal Regulations— (a) omit "216(1)(a),"; and (b) for ", 223, 228ZBA(3) and 228ZM(2)" substitute "and 223". -- 4 of 8 -- Infringements (General) Further Amendment Regulations 2015 S.R. No. 100/2015 4 Authorised by the Chief Parliamentary Counsel (2) For item 11.3 of Schedule 3 to the Principal Regulations substitute— "11.3 Regulations 7(1), 7(2), 8, 9, 10(1), 11(1), 11(2), 11(3), 11(4), 12, 13(1), 13(2), 13(3), 13(5), 13(6), 14(1), 14(2), 14(3), 14(4), 14(5), 14(6), 14(7), 15(2), 15(3), 15(4) and 15(5) of the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015.". (3) For item 11.4 of Schedule 3 to the Principal Regulations substitute— "11.4 Regulations 16(a), 16(b), 16(c), 16(d), 16(e), 16(f), 16(g), 16(h), 17, 18, 20, 21(1), 21(2), 21(3), 21(4), 21(5), 21(6), 21(7) and 21(8) of the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015.". (4) For item 11.5 of Schedule 3 to the Principal Regulations substitute— "11.5 Regulations 22(1), 22(2)(a), 22(2)(b), 22(2)(c), 22(2)(d), 22(2)(e), 22(2)(f), 23(1), 23(2)(a), 23(2)(b), 23(2)(c), 23(2)(d), 23(2)(e), 23(2)(f), 24(1), 24(2)(a), 24(2)(b), 25(1), 25(2), 25(3) and 25(4) of the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015.". (5) For item 11.6 of Schedule 3 to the Principal Regulations substitute— "11.6 Regulations 26(a), 26(b), 27(1), 28, 29(1), 30(1), 30(2), 31(1), 31(2), 32(1), 33(1), 33(2), 34(1), 34(2), 35(1), 35(2), 36, 37, 38, 39(1), 39(3), 39(5), 40 and 66(4) of the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015.". -- 5 of 8 -- Infringements (General) Further Amendment Regulations 2015 S.R. No. 100/2015 5 Authorised by the Chief Parliamentary Counsel (6) For item 11.7 of Schedule 3 to the Principal Regulations substitute— "11.7 Regulations 43, 45, 46, 47(4), 51(1), 56(1), 57(3) and 63(6) of the Transport (Compliance and Miscellaneous) (Conduct on Public Transport) Regulations 2015.". (7) For item 11.8 of Schedule 3 to the Principal Regulations substitute— "11.8 Regulations 6(2), 8, 11(3), 11A(2), 11A(3), 11A(4), 11A(5), 11A(6), 11A(7), 12(2), 14(1), 14(4), 15(1), 15(2), 16(2), 18(1), 18(2), 19(2), 19(3), 19(4), 20(3), 20(4), 21(2), 22(a), 22B(1), 22B(2), 22B(3), 22C(2), 22C(5), 22C(7), 22E, 23(2), 23(3), 24(1), 24(2), 25(1), 25(2), 26(1), 26(2), 26(3), 26(4), 26(5), 29(1), 29(2), 29(3) and 29(4) of the Transport (Buses, Taxi-Cabs and Other Commercial Passenger Vehicles) Regulations 2005.". (8) For item 11.9 of Schedule 3 to the Principal Regulations substitute— "11.9 Regulations 30(1), 30(2), 31(1), 33(1), 33(2), 35(1), 35(2), 36(2), 37(1), 37(2), 38(3), 38(4), 39(1), 39(2), 40, 41(8), 41(9)(a), 41(9)(b), 43(1), 43(2), 43(3), 43(5), 43(6), 43(7), 44(1), 44(2), 44(4), 44(6), 44(8), 44(9), 45(1), 45(2), 45(3), 45(4A), 45(5), 45(6)(a), 45(6)(b), 46, 46A(1) and 46A(2) of the Transport (Buses, Taxi-Cabs and Other Commercial Passenger Vehicles) Regulations 2005.". 12 Item 11A of Schedule 3 revoked—Travel Agents Act 1986 Item 11A of Schedule 3 to the Principal Regulations is revoked. -- 6 of 8 -- Infringements (General) Further Amendment Regulations 2015 S.R. No. 100/2015 6 Authorised by the Chief Parliamentary Counsel 13 Schedule 4 amended—Electricity Safety Act 1998 (1) Item 4.3 of Schedule 4 to the Principal Regulations is revoked. (2) For item 4.7 of Schedule 4 to the Principal Regulations substitute— "4.7 Regulations 9(2), 9(3), 10(2), 10(3), 10(4), 10(5), 10(6), 10(7) and 11(2) of the Electricity Safety (Electric Line Clearance) Regulations 2015.". 14 Schedule 4 amended—Marine Safety Act 2010 (1) In item 7BA.4 of Schedule 4 to the Principal Regulations omit ", 162A(5)". (2) After item 7BA.4 of Schedule 4 to the Principal Regulations insert— "7BA.4A Section 162A(5) constituted by a failure to comply with section 162A(2)(b) of the Act.". (3) In item 7BA.37 of Schedule 4 to the Principal Regulations after "96(6)," insert "96(8),". 15 Schedule 4 amended—Port Management Act 1995 For item 8B.1 of Schedule 4 to the Principal Regulations substitute— "8B.1 Regulations 22, 23, 26(1), 27(1), 29(1), 29(2), 30(1), 30(2), 31(1), 31(2), 32, 33(1)(a), 33(1)(b), 41(1), 43, 49, 50(1), 51(1), 52(1), 52(2), 52(3), 53, 56(1), 56(2), 57, 60, 62, 63(1), 65 and 66(3) of the Port Management (Local Ports) Regulations 2015.". ═══════════════ -- 7 of 8 -- Endnotes Infringements (General) Further Amendment Regulations 2015 S.R.
