No. 123/2015 Land Conservation (Vehicle Control) Act 1972 Land Conservation (Vehicle Control) Amendment Regulations 2015 The Governor in Council makes the following Regulations: Dated: 27 October 2015 Responsible Minister: LISA NEVILLE Minister for Environment, Climate Change and Water MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Land Conservation (Vehicle Control) Regulations 2013 in relation to the application of certain regulations. 2 Authorising provision These Regulations are made under section 3 of the Land Conservation (Vehicle Control) Act 1972. 3 Principal Regulations In these Regulations, the Land Conservation (Vehicle Control) Regulations 20131 are called the Principal Regulations. -- 2 of 5 -- Land Conservation (Vehicle Control) Amendment Regulations 2015 S.R. No. 123/2015 2 Authorised by the Chief Parliamentary Counsel 4 Definitions In regulation 5 of the Principal Regulations insert the following definitions— "public authority land means land of the type described in paragraph (e) of the definition of public land in section 2 of the Act; relevant land Act means— (a) the Crown Land (Reserves) Act 1978; or (b) the Forests Act 1958; or (c) the Land Act 1958; or (d) the National Parks Act 1975; or (e) Parts II and IIA of the Wildlife Act 1975; or (f) any other Act— (i) that provides for the use, management or control of particular land, or a particular class of land, reserved under the Crown Land (Reserves) Act 1978; and (ii) under which a lease, licence or other authority may be granted, issued or given in respect of such land; or (g) any other Act under which a lease, licence or other authority may be granted, issued or given in respect of public authority land;". -- 3 of 5 -- Land Conservation (Vehicle Control) Amendment Regulations 2015 S.R. No. 123/2015 3 Authorised by the Chief Parliamentary Counsel 5 Application of certain regulations For regulation 6(d) and (e) of the Principal Regulations substitute— "(d) a person acting in accordance with a lease, licence or other authority granted, issued or given under a relevant land Act; (e) an employee, agent or contractor of a person referred to in paragraph (d) when acting in their capacity as an employee, agent or contractor of that person and in accordance with that lease, licence or authority;". ═══════════════ -- 4 of 5 -- Endnotes Land Conservation (Vehicle Control) Amendment Regulations 2015 S.R.
