No. 26/2015 Tobacco Act 1987 Tobacco Amendment Regulations 2015 The Governor in Council makes the following Regulations: Dated: 14 April 2015 Responsible Minister: JILL HENNESSY Minister for Health YVETTE CARISBROOKE Clerk of the Executive Council 1 Objective The objective of these Regulations is to make consequential amendments to the Tobacco Regulations 2007 as a result of the commencement of the Tobacco Amendment Act 2014. 2 Authorising provision These Regulations are made under section 43 of the Tobacco Act 1987. 3 Principal Regulations In these Regulations, the Tobacco Regulations 20071 are called the Principal Regulations. Authorised by the Chief Parliamentary Counsel 1 -- 2 of 5 -- Tobacco Amendment Regulations 2015 S.R. No. 26/2015 4 Regulation 11 substituted For regulation 11 of the Principal Regulations substitute— "11 Acknowledgement of consent (1) For the purposes of section 36D(3) of the Act, the prescribed form of acknowledgement of consent by an occupier of premises to an entry and search of the premises and the seizure or taking of anything during the search is Form 1 in Schedule 4. (2) For the purposes of section 36EA(5) of the Act, the prescribed form of acknowledgement of consent by an occupier of premises to an entry and inspection of the premises is Form 2 in Schedule 4.". 5 Amendment to Schedule 4 (1) After the heading to Schedule 4 to the Principal Regulations insert— "FORM 1". (2) In Schedule 4 to the Principal Regulations for "Regulation 11" substitute "Regulation 11(1)". 2 Authorised by the Chief Parliamentary Counsel -- 3 of 5 -- Tobacco Amendment Regulations 2015 S.R. No. 26/2015 (3) At the end of Schedule 4 to the Principal Regulations insert— "FORM 2 Regulation 11(2) Tobacco Act 1987 (section 36EA) ENTRY AND INSPECTION ACKNOWLEDGEMENT OF OCCUPIER'S CONSENT Name of inspector: Details of premises: Name of occupier: Address: Consent to entry and inspection: Purpose of entry and inspection: Statement of occupier— • The inspector has informed me of the purpose of the inspection. • I have been informed that I may refuse to give consent to the entry and inspection. • I consent to entry and inspection of the premises.
