No. 167/2015 Victorian Energy Efficiency Target Act 2007 Victorian Energy Efficiency Target Amendment Regulations 2015 The Governor in Council makes the following Regulations: Dated: 22 December 2015 Responsible Minister: LILY D'AMBROSIO Minister for Energy and Resources ANDREW ROBINSON Clerk of the Executive Council Part 1—Preliminary 1 Objective The objective of these Regulations is to amend the Victorian Energy Efficiency Target Regulations 2008 to— (a) modify the method and variables to be used to calculate in tonnes the carbon dioxide equivalent of greenhouse gases to be reduced by certain prescribed activities; and (b) make changes to certain prescribed activities; and (c) incorporate more recent versions of certain documents that are relevant to certain prescribed activities; and (d) make other minor and technical amendments. -- 2 of 58 -- Part 1—Preliminary Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 2 2 Authorising provision These Regulations are made under section 75 of the Victorian Energy Efficiency Target Act 2007. 3 Commencement (1) These Regulations (except Parts 3 and 4) come into operation on 1 January 2016. (2) Part 3 comes into operation on 1 February 2016. (3) Part 4 comes into operation on 1 March 2016. 4 Principal Regulations In these Regulations, the Victorian Energy Efficiency Target Regulations 20081 are called the Principal Regulations. -- 3 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 3 Part 2—January 2016 amendments 5 Definitions In regulation 4 of the Principal Regulations insert the following definition— "three-phase cage induction motor means an electric motor that is within the scope of AS/NZS 1359.5:2004 as described in clause 1.1 of that Standard but does not include equipment of the type referred to in clause 1.2 of that Standard;". 6 Prescribed activities (1) In regulation 6(1) of the Principal Regulations— (a) in paragraphs (g), (h) and (j), omit "if the premises are in a non-gas reticulated area,"; (b) for paragraph (q) substitute— "(q) installing lamps that comply with the criteria specified in Part A of Schedule 21 in place of incandescent lamps that do not comply with those criteria and— (i) decommissioning the non-complying incandescent lamps; and (ii) if the installed lamps comply with the criteria specified in item 21D in Part A of Schedule 21, decommissioning the transformer associated with the non-complying incandescent lamps;". -- 4 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 4 (2) In regulation 6(3) of the Principal Regulations— (a) for paragraphs (a), (b) and (c) substitute— "(a) installing a motor that complies with the criteria specified in Part A of Schedule 31; (b) installing a refrigerated display cabinet that complies with the criteria specified in Part A of Schedule 32; (c) installing a fan motor that complies with the criteria specified in Part A of Schedule 33 in a refrigerated display cabinet, commercial freezer or cool room;"; (b) in paragraph (d) omit "in a building or structure that is classified under Part A3 of the 2008 edition of the Building Code as Class 5, 6, 7, 8, 9 or 10(b),". 7 Certificate not to be created more than once for same product or activity in residential premises In regulation 8(2)(c) of the Principal Regulations omit "18 or". 8 Regulation 13 substituted For regulation 13 of the Principal Regulations substitute— "13 Prescribed greenhouse gas scheme For the purposes of the definition of prescribed greenhouse gas scheme in section 3(1) of the Act, the scheme established under the Carbon Credits (Carbon Farming Initiative) Act 2011 of the Commonwealth for the issue of Australian carbon credit units in relation to eligible offsets projects is prescribed.". -- 5 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 5 9 Schedule 7 amended (1) In Schedule 7 to the Principal Regulations, for "If the premises are in a non-gas reticulated area, decommissioning" substitute "Decommissioning". (2) In Schedule 7 to the Principal Regulations, in Part A, for item 7A substitute— "7A A product that— (a) complies with the MEPS requirement set out in column 4 of Table 3.1 of AS/NZS 3823.2:2013; and (b) achieves an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of not less than 3.7; and (c) has a rated output heating capacity, as determined in accordance with AS/NZS 3823.1.2:2012, of not less than 10kW at the H1 temperature condition; and (d) is listed on the ESC register.". (3) In Schedule 7 to the Principal Regulations, in Part B, for the item headed "7A Abatement factor:" substitute— "7A Abatement factor: (a) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.2:2012, of not less than 10 and not more than 18 kW at the H1 temperature condition and has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 3⋅7 and not more than 3∙99: 1∙25; -- 6 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 6 (ii) not less than 4 and not more than 4∙29: 4∙62; (iii) not less than 4∙3 and not more than 4∙59: 7∙52; (iv) 4∙6 or more: 10∙04; (b) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.2:2012, of more than 18 and not more than 28 kW at the H1 temperature condition and has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 3∙7 and not more than 3∙99: 3∙25; (ii) not less than 4 and not more than 4∙29: 7∙51; (iii) not less than 4⋅3 and not more than 4∙59: 11∙18; (iv) 4∙6 or more: 14∙37; (c) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.2:2012, of more than 28 kW at the H1 temperature condition and has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 3∙7 and not more than 3∙99: 6∙26; (ii) not less than 4 and not more than 4∙29: 11∙58; (iii) not less than 4∙3 and not more than 4∙59: 16∙15; (iv) 4∙6 or more: 20∙13.". -- 7 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 7 (4) In Schedule 7 to the Principal Regulations, in Part B, in the item headed "7A Regional factor:"— (a) in paragraph (c), for "1∙71" substitute "1∙72"; (b) in paragraph (d), for "0∙74" substitute "0∙75". 10 Schedule 8 amended (1) In Schedule 8 to the Principal Regulations, for "If the premises are in a non-gas reticulated area, decommissioning" substitute "Decommissioning". (2) In Schedule 8 to the Principal Regulations, in Part A, for item 8A substitute— "8A A product that— (a) complies with the MEPS requirement set out in column 4 of Table 3.1 of AS/NZS 3823.2:2013; and (b) achieves an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of not less than 3.7; and (c) has a rated output heating capacity, as determined in accordance with AS/NZS 3823.1.2:2012, of not less than 10 kW at the H1 temperature condition; and (d) is listed in the ESC register.". -- 8 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 8 (3) In Schedule 8 to the Principal Regulations, in Part B, for the item headed "8A Abatement factor:" substitute— "8A Abatement factor: (a) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.2:2012, of not less than 10 and not more than 18 kW at the H1 temperature condition and has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 3∙7 and not more than 3∙99: 102∙0; (ii) not less than 4 and not more than 4∙29: 107∙0; (iii) not less than 4∙3 and not more than 4∙59: 111∙2; (iv) 4∙6 or more: 114∙8; (b) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.2:2012, of more than 18 and not more than 28 kW at the H1 temperature condition and has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 3∙7 and not more than 3∙99: 129·9; (ii) not less than 4 and not more than 4∙29: 136∙0; (iii) not less than 4∙3 and not more than 4∙59: 141∙2; (iv) 4∙6 or more: 145∙8; -- 9 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 9 (c) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.2:2012, of more than 28 kW at the H1 temperature condition and has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 3∙7 and not more than 3∙99: 165∙4; (ii) not less than 4 and not more than 4∙29: 172∙7; (iii) not less than 4∙3 and not more than 4∙59: 179∙0; (iv) 4∙6 or more: 184∙5.". No. 167/2015 Authorised by the Chief Parliamentary Counsel 11 (b) achieves an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013 when tested in accordance with AS/NZS 3823.1.1:2012, of not less than 4; and (c) has a heating capacity, as determined in accordance with AS/NZS 3823.1.1:2012, of not less than 2 kW at the H1 temperature condition; and (d) is listed in the ESC register.". (3) In Schedule 10 to the Principal Regulations, in Part B, for the item headed "10A Abatement factor:" substitute— "10A Abatement factor: (a) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.1:2012, of not less than 2 and not more than 2∙99 kW at the H1 temperature condition and has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 4 and not more than 4∙49: 4∙64; (ii) not less than 4∙5 and not more than 4∙99: 5∙48; (iii) not less than 5 and not more than 5∙49: 6∙14; (iv) 5∙5 or more: 6∙69; (b) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.1:2012, of not less than 3 and not more than 6 kW at the H1 temperature condition and has an annual -- 12 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 12 coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 4 and not more than 4∙49: 8∙33; (ii) not less than 4∙5 and not more than 4∙99: 9∙91; (iii) not less than 5 and not more than 5∙49: 11∙17; (iv) 5∙5 or more: 12∙20; (c) If the product has a heating capacity, as determined in accordance with AS/NZS 3823.1.1:2012, of more than 6 kW at the H1 temperature condition and has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of— (i) not less than 4 and not more than 4∙49: 11∙51; (ii) not less than 4∙5 and not more than 4∙99: 13∙42; (iii) not less than 5 and not more than 5∙49: 14∙95; (iv) 5∙5 or more: 16∙20.". (4) In Schedule 10 to the Principal Regulations, in Part B, for the item headed "10A Regional factor:" substitute— "10A Regional factor: (a) If the product has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of not less than 4 and is installed in metropolitan Victoria: 1⋅00; -- 13 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 14 (e) If the product has an annual coefficient of performance, as determined in accordance with AS/NZS 3823.2:2013, of 5∙5 or more and— (i) is installed in regional Victoria— climatic region Mild: 0∙50; (ii) is installed in regional Victoria— climatic region Cold: 0∙79; (iii) is installed in regional Victoria— climatic region Hot: 0∙38.". 13 Schedule 31 amended (1) In Schedule 31 to the Principal Regulations— (a) in the heading omit "REPLACING AN ELECTRIC MOTOR"; (b) for "Prescribed activity under regulation 6(3)(a): Decommissioning a three-phase electric motor with a minimum rated output between 0·75 and 185 kW that does not comply with the criteria specified in Part A of Schedule 31 and installing a product that complies with the criteria specified in Part A of Schedule 31." substitute "Prescribed activity under regulation 6(3)(a): Installing a three-phase induction motor that complies with the criteria specified in Part A of Schedule 31.". (2) In Schedule 31 to the Principal Regulations, in Part A, for item 31A substitute— "31A A three-phase cage induction motor that— (a) has a rated output, as determined in accordance with AS 60034.1-2009, of not less than 0∙75 and not more than 185 kW; and -- 15 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. (3) In Schedule 31 to the Principal Regulations, in Part A, for item 31B substitute— "31B A three-phase cage induction motor that— (a) has a rated output, as determined in accordance with AS 60034.1-2009, of not less than 0∙75 and not more than 185 kW; and (b) meets the requirements for an IE4 (super-premium) efficiency level motor proposed in Appendix A of IEC/TS 60034-31 when tested in accordance with IEC 60034-2-1; and (c) has 2, 4 or 6 poles; and (d) is listed on the ESC register.". (4) In Schedule 31 to the Principal Regulations, in Part B, omit "the decommissioning of a three-phase electric motor with a rated output between 0∙75 and 185kW that does not meet the requirements of Part A and". -- 16 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R. No. 167/2015 Authorised by the Chief Parliamentary Counsel 21 (5) In Schedule 32 to the Principal Regulations, in Part C, for item 32A substitute— "32A At the beginning of the day on which the installed product is first able to deliver refrigeration.". 15 Schedule 33 amended (1) In Schedule 33 of the Principal Regulations— (a) in the heading, for "REPLACEMENT" substitute "MOTOR"; (b) for "Prescribed activity under regulation 6(3)(c): Installing a product that complies with the criteria specified in Part A of Schedule 33 after decommissioning a fan that is used in a refrigerated display cabinet, commercial freezer or cool room and its associated motor, being a motor that is of a certain type." substitute "Prescribed activity under regulation 6(3)(c): Installing a product that complies with the criteria specified in Part A of Schedule 33 in a refrigerated display cabinet, commercial freezer or cool room.". (2) In Schedule 33 of the Principal Regulations, in Part A, for item 33A substitute— "33A A fan that is powered by an electronically commutated motor (being a permanent magnet motor with electronic commutation) that is listed in the ESC register and— (a) in the case of an internal rotor motor, has a rated motor output of not more than 600 watts; or (b) in the case of an external rotor motor, has a rated motor input of not more than 800 watts.". -- 22 of 58 -- Part 2—January 2016 amendments Victorian Energy Efficiency Target Amendment Regulations 2015 S.R.
