No. 138/2014 Criminal Organisations Control Act 2012 Criminal Organisations Control Amendment Regulations 2014 The Governor in Council makes the following Regulations: Dated: 23 September 2014 Responsible Minister: ROBERT CLARK Attorney-General YVETTE CARISBROOKE Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Criminal Organisations Control Regulations 2013 to— (a) reflect the insertion into the Criminal Organisations Control Act 2012, by the Criminal Organisations Control and Other Acts Amendment Act 2014, of a requirement to affix, to or near certain premises, a notice of a control order that applies to a declared organisation; and (b) change references to provisions of the Criminal Organisations Control Act 2012 as a consequence of amendments made to those provisions by the Criminal Organisations Control and Other Acts Amendment Act 2014. -- 2 of 4 -- S.R. No. 138/2014 Criminal Organisations Control Amendment Regulations 2014 2 Authorised by the Chief Parliamentary Counsel 2 Authorising provision These Regulations are made under section 138 of the Criminal Organisations Control Act 2012. 3 Commencement These Regulations come into operation on 1 October 2014. 4 Amendment of objective Regulation 1(b) of the Criminal Organisations Control Regulations 20131 is revoked. 5 Regulation 9 substituted For regulation 9 of the Criminal Organisations Control Regulations 2013 substitute— "9 Notice of making of control order that applies to a declared organisation For the purpose of section 55(4) of the Act, the prescribed form of a notice of a control order which applies to a declared organisation is Form 3 set out in the Schedule.". 6 Schedule amended In the Schedule to the Criminal Organisations Control Regulations 2013— (a) in Form 3, for "section 43(1)" substitute "section *43(1)/*43(1A)"; (b) in Form 5, for "section 58" substitute "section 58A". ═══════════════ r. 2 -- 3 of 4 -- S.R.
