No. 152/2014 Infringements Act 2006 Infringements (General) Further Amendment Regulations 2014 The Governor in Council makes the following Regulations: Dated: 7 October 2014 Responsible Minister: ROBERT CLARK Attorney-General YVETTE CARISBROOKE Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Infringements (General) Regulations 2006 to prescribe certain infringement offences under the Estate Agents Act 1980, the Mineral Resources (Sustainable Development) Act 1990, the Motor Car Traders Act 1986, the Road Safety Act 1986 and the Sale of Land Act 1962 as lodgeable infringement offences for the purpose of enforcement under the Infringements Act 2006. 2 Authorising provision These Regulations are made under section 168 of the Infringements Act 2006. 3 Commencement (1) These Regulations (except for regulations 7 and 8) come into operation on the day on which they are made. -- 2 of 5 -- S.R. (3) Regulation 8 comes into operation on 3 November 2014. 4 Principal Regulations In these Regulations, the Infringements (General) Regulations 2006 1 are called the Principal Regulations. 5 Lodgeable infringement offences—item 2 of Schedule 3 substituted For item 2 of Schedule 3 to the Principal Regulations substitute— "2 Estate Agents Act 1980 2.1 Sections 16(7), 21B(2), 29A(1), 30A(1), 41(1), 41(2), 42(1), 43(1), 47(2), 47(2A), 47A(1), 47D(3), 48(2), 48A(2), 49A(2), 59(7), 63(3), 63(3B), 63(5)(a), 63(5)(b), 64(1), 64(1A), 64(2A), 64(3), 64(9), 64(13), 64B(1)(a), 64B(1)(b), 69(1B), 70B and 98A(1). 2.2 Regulations 5(1), 5(2), 5(4), 6, 10, 11(2), 12(1), 13(1), 13(2), 13(3), 13(4), 14(8), 15(8), 16(2), 16(3), 17(1), 18(1), 18(2), 18(4), 18(5), 19(1), 19(3), 19(4), 20, 21(1), 22(1), 22(2), 23(1), 23(3), 23(4), 23(5), 23(6), 23(7), 23(8), 24(2), 24(4), 25(1), 26(1), 26(2), 29(2), 29(3), 29(5) and 30(1) of the Estate Agents (General, Accounts and Audit) Regulations 2008.". 6 Lodgeable infringement offences—Road Safety Act 1986 (1) In item 9A.5 of Schedule 3 to the Principal Regulations after "197(1A)," insert "197(1B),". r. 4 -- 3 of 5 -- S.R. No. 152/2014 Infringements (General) Further Amendment Regulations 2014 3 Authorised by the Chief Parliamentary Counsel (2) In item 9A.9 of Schedule 3 to the Principal Regulations— (a) after "58(1)(b)," insert "58(1A)(a), 58(1A)(b), 58(1A)(c),"; (b) after "58(2)(b)," insert "58(2)(c), 58(2)(d),". 7 Lodgeable infringement offences—Mineral Resources (Sustainable Development) Act 1990 In item 7C.1 of Schedule 4 to the Principal Regulations after "62(3)" insert ", 80(4A)". 8 Lodgeable infringement offences—Motor Car Traders Act 1986 (1) In item 8.1 of Schedule 4 to the Principal Regulations omit "43(1B),". (2) In item 8.2 of Schedule 4 to the Principal Regulations— (a) after "19(2)," insert "19(7A),"; (b) for "and 21(2)" substitute ", 21(2) and 24A". 9 New item 11B inserted into Schedule 4 After item 11A of Schedule 4 to the Principal Regulations insert— "11B Sale of Land Act 1962 11B.1 Sections 33B(1), 33B(2), 33B(4), 33B(5) and 43. 11B.2 Regulations 6(1), 6(2), 6(3), 6(4) and 6(5) of the Sale of Land (Public Auctions) Regulations 2014.". ═══════════════ r. 7 -- 4 of 5 -- S.R.
