No. 2/2014 Meat Industry Act 1993 Meat Industry Amendment Regulations 2014 The Governor in Council makes the following Regulations: Dated: 11 February 2014 Responsible Minister: PETER WALSH Minister for Agriculture and Food Security YVETTE CARISBROOKE Clerk of the Executive Council 1 Objectives The objective of these Regulations is to amend the Meat Industry Regulations 2005— (a) to prescribe matters relating to the branding of carcasses and meat; (b) to prescribe matters relating to licences; (c) to update references to standards; (d) to make minor miscellaneous amendments. 2 Authorising provision These Regulations are made under section 78 of the Meat Industry Act 1993. 3 Commencement These Regulations come into operation on 14 February 2014. -- 2 of 6 -- S.R. No. 2/2014 Meat Industry Amendment Regulations 2014 2 Authorised by the Chief Parliamentary Counsel 4 Principal Regulations In these Regulations, the Meat Industry Regulations 2005 1 are called the Principal Regulations. 5 Definitions In regulation 5 of the Principal Regulations— (a) the definition of AS 4465:2001 is revoked; (b) for the definition of AS 4696:2002 substitute— "AS 4696:2007 means AS 4696:2007 known as the Australian Standard for the Hygienic Production and Transportation of Meat and Meat Products for Human Consumption, as made from time to time;"; (c) the definition of goat is revoked. 6 Branding and re-inspection of meat For regulation 11(1) of the Principal Regulations substitute— "(1) Each brand applied to a carcass intended for human consumption must be applied so that it is fully legible and remains so during the times it would be normally necessary for the origin of the carcass or meat to be ascertained.". r. 4 -- 3 of 6 -- S.R. No. 2/2014 Meat Industry Amendment Regulations 2014 3 Authorised by the Chief Parliamentary Counsel 7 Description of brands For regulation 13(7) of the Principal Regulations substitute— "(3) For all carcasses and meat other than those specified in subregulation (1), the brand must consist of a circle within which letters and the licence number of the facility are centred within the circle. Example ". 8 Whole carcasses—application of brands (1) In regulation 14(1)(a) of the Principal Regulations omit "to the tongue and". (2) In regulation 14(1)(c) of the Principal Regulations for "mutton" substitute "an ovine animal". (3) In regulation 14(3) of the Principal Regulations omit "or (2)". 9 Specification of brands In regulation 16 of the Principal Regulations— (a) in paragraph (b), for "height; and" substitute "height."; and (b) paragraph (c) is revoked. 10 Regulation 17 revoked Regulation 17 of the Principal Regulations is revoked. r. 7 -- 4 of 6 -- S.R. No. 2/2014 Meat Industry Amendment Regulations 2014 4 Authorised by the Chief Parliamentary Counsel 11 Issuing and renewal of licences For regulation 22(2) of the Principal Regulations substitute— "(2) The Authority must not issue a new licence or a renewed licence unless the meat transport vehicle, if used for the conveyance of meat including poultry meat, complies with Part 25 of AS 4696:2007.". 12 Responsibilities of owner of licensed meat transport vehicle For regulation 25(1) and (2) of the Principal Regulations substitute— "(1) The owner of a licensed meat transport vehicle used for the conveyance of meat, including poultry meat, must comply with Part 25 of AS 4696:2007.". 13 Suspension or revocation of licence In regulation 26(1) of the Principal Regulations for paragraphs (a), (b), (c) and (d) substitute— "(a) the meat transport vehicle used for the conveyance of meat, including poultry meat, no longer complies with Part 25 of AS 4696:2007; or (b) the meat transport vehicle is not in good order or condition; or (c) a term or condition of the licence has been breached.". 14 Part 6 revoked Part 6 of the Principal Regulations is revoked. ═══════════════ r. 11 -- 5 of 6 -- S.R.
