No. 188/2014 Wrongs Act 1958 Wrongs (Part VBA) (Asbestos Related Claims) Regulations 2014 The Governor in Council makes the following Regulations: Dated: 29 October 2014 Responsible Minister: ROBERT CLARK Attorney-General YVETTE CARISBROOKE Clerk of the Executive Council 1 Objective The objective of these Regulations is to exclude claims in proceedings for damages for asbestos- related conditions from the operation of Part VBA of the Wrongs Act 1958. 2 Authorising provision These Regulations are made under section 28LZP of the Wrongs Act 1958. 3 Commencement These Regulations come into operation on 30 October 2014. -- 2 of 3 -- S.R. No. 188/2014 Wrongs (Part VBA) (Asbestos Related Claims) Regulations 2014 2 Authorised by the Chief Parliamentary Counsel 4 Definitions In these Regulations— asbestos-related condition has the same meaning as in the Asbestos Diseases Compensation Act 2008; the Act means the Wrongs Act 1958. 5 Classes of claims in proceedings excluded from Part VBA A claim in a proceeding for damages in respect of an injury that is an asbestos-related condition is excluded from the operation of Part VBA of the Act to the extent that it is not already excluded under section 28LC(2) of the Act. 6 Transitional These Regulations apply to a claim in a proceeding for damages in respect of an injury that is an asbestos-related condition commenced on or after the commencement of the Regulations irrespective of when the act or omission causing the injury (and giving rise to the claim for damages in respect of that injury) occurs. ═══════════════ r. 4 -- 3 of 3 --
