No. 66/2013 Conservation, Forests and Lands Act 1987 Conservation, Forests and Lands (Infringement Notice) Regulations 2013 The Governor in Council makes the following Regulations: Dated: 18 June 2013 Responsible Minister: RYAN SMITH Minister for Environment and Climate Change MATTHEW McBEATH Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe— (a) the offences against a relevant law for which an infringement notice may be served; (b) infringement penalties for those prescribed infringement offences. 2 Authorising provision These Regulations are made under section 99 of the Conservation, Forests and Lands Act 1987. 3 Commencement These Regulations come into operation on 23 June 2013. -- 2 of 78 -- S.R. No. 66/2013 Conservation, Forests and Lands (Infringement Notice) Regulations 2013 2 Authorised by the Chief Parliamentary Counsel 4 Revocations The Regulations set out in Schedule 1 are revoked. 5 Prescribed infringement offences For the purposes of section 91(1) of the Conservation, Forests and Lands Act 1987, an offence specified in Column 2 of Schedules 2, 3, 4, 5, 6 and 7 is prescribed as an infringement offence. 6 Prescribed infringement penalties For the purposes of section 91(3) of the Conservation, Forests and Lands Act 1987, the prescribed infringement penalty for an infringement offence is the penalty set out in the corresponding entry of Column 3 of Schedules 2, 3, 4, 5, 6 and 7 in respect of that infringement offence. __________________ r. 4 -- 3 of 78 -- S.R. No. 66/2013 Conservation, Forests and Lands (Infringement Notice) Regulations 2013 77 Authorised by the Chief Parliamentary Counsel ENDNOTES Penalty Units These Regulations provide for penalties by reference to penalty units within the meaning of section 110 of the Sentencing Act 1991. The amount of the penalty is to be calculated, in accordance with section 7 of the Monetary Units Act 2004, by multiplying the number of penalty units applicable by the value of a penalty unit. In accordance with section 11 of the Monetary Units Act 2004, the value of a penalty unit for the financial year commencing 1 July 2012 is $140.84. The amount of the calculated penalty may be rounded to the nearest dollar. The value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a penalty unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year. Endnotes -- 78 of 78 --
