No. 61/2013 Conservation, Forests and Lands Act 1987 Conservation, Forests and Lands (Primary Industries Infringement Notices) Regulations 2013 The Governor in Council makes the following Regulations: Dated: 18 June 2013 Responsible Minister: PETER WALSH Minister for Agriculture and Food Security MATTHEW McBEATH Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe— (a) the offences against a relevant law for which an infringement notice may be served; (b) infringement penalties for those infringement offences. 2 Authorising provision These Regulations are made under section 99 of the Conservation, Forests and Lands Act 1987. 3 Commencement These Regulations come into operation on 23 June 2013. -- 5 of 74 -- S.R. No. 61/2013 Conservation, Forests and Lands (Primary Industries Infringement Notices) Regulations 2013 2 Authorised by the Chief Parliamentary Counsel 4 Prescribed infringement offences (1) For the purposes of section 91(1) of the Conservation, Forests and Lands Act 1987, an offence specified in Column 2 of Schedules 1 and 2 is prescribed as an infringement offence. (2) For the purposes of section 91(1) of the Conservation, Forests and Lands Act 1987, an offence specified in Column 2 of Schedule 3 that is committed in relation to timber harvesting operations in a public safety zone declared under section 4 of the Safety on Public Land Act 2004 published in Government Gazette S445 on 19 December 2012 is prescribed as an infringement offence. 5 Prescribed infringement penalties For the purposes of section 91(3) of the Conservation, Forests and Lands Act 1987, the prescribed infringement penalty for an infringement offence is the penalty set out in the corresponding entry of Column 3 of Schedules 1, 2 and 3 in respect of that infringement offence. __________________ r. 4 -- 6 of 74 -- S.R. No. 61/2013 Conservation, Forests and Lands (Primary Industries Infringement Notices) Regulations 2013 7 Authorised by the Chief Parliamentary Counsel SCHEDULE 2 Regulations 4(1) and 5 PRESCRIBED FISHERIES INFRINGEMENT OFFENCES AND INFRINGEMENT PENALTIES In this Schedule— abalone aquaculture licence means— (a) an Aquaculture (Crown Land—Abalone) Licence created by regulation 14(a) of the Regulations; or (b) an Aquaculture (On-shore Abalone) Licence created by regulation 14(f) of the Regulations; AFAL means an abalone fishery access licence within the meaning of the Regulations; AL means an access licence within the meaning of the Act; AQL means an aquaculture licence within the meaning of the Act; BGFAL means a Bait (General) Fishery Access Licence created by regulation 12(d) of the Regulations; CFL means a commercial fishery licence within the meaning of the Regulations; CIFAL means a Corner Inlet Fishery Access Licence created by regulation 12(e) of the Regulations; designated licence condition has the same meaning as it has in the Act; EFAL means an Eel Fishery Access Licence created by regulation 12(f) of the Regulations; FRAL means a Fish Receivers' (Abalone) Licence created by regulation 13(a) of the Regulations; FRSL means a Fish Receivers' (Scallop) Licence created by regulation 13(b) of the Regulations; Sch. 2 -- 11 of 74 -- S.R. No. 61/2013 Conservation, Forests and Lands (Primary Industries Infringement Notices) Regulations 2013 8 Authorised by the Chief Parliamentary Counsel GCFWZAL means a Giant Crab Fishery (Western Zone) Access Licence created by regulation 12(g) of the Regulations; GLBFAL means a Gippsland Lakes (Bait) Fishery Access Licence created by regulation 12(i) of the Regulations; GLFAL means a Gippsland Lakes Fishery Access Licence created by regulation 12(h) of the Regulations; GLMDFAL means a Gippsland Lakes (Mussel Dive) Fishery Access Licence created by regulation 12(j) of the Regulations; LTBFAL means a Lake Tyers (Bait) Fishery Access Licence created by regulation 12(k) of the Regulations; MLLBFAL means a Mallacoota Lower Lake (Bait) Fishery Access Licence created by regulation 12(l) of the Regulations; OFAL means an Ocean Fishery Access Licence created by regulation 12(m) of the Regulations; PPBMBFAL means a Port Phillip Bay (Mussel Bait) Fishery Access Licence created by regulation 12(n) of the Regulations; priority species has the same meaning as it has in the Act; RLFAL means a rock lobster fishery access licence within the meaning of the Regulations; SIBFAL means a Sydenham Inlet (Bait) Fishery Access Licence created by regulation 12(u) of the Regulations; SOFAL means a Scallop (Ocean) Fishery Access Licence created by regulation 12(s) of the Regulations; SRBFAL means a Snowy River (Bait) Fishery Access Licence created by regulation 12(t) of the Regulations; the Act means the Fisheries Act 1995; the Regulations means the Fisheries Regulations 2009 2 ; TIFAL means a Trawl (Inshore) Fishery Access Licence created by regulation 12(v) of the Regulations; WOFAL means a Wrasse (Ocean) Fishery Access Licence created by regulation 12(x) of the Regulations; Sch. 2 -- 12 of 74 -- S.R. No. 99/2012 as amended by S.R. No. 161/2012. 2 Schedule 2 definition of the Regulations: S.R. No. 2/2009 as amended by S.R. Nos 19/2009, 118/2010 and 18/2013. —— Penalty Units These Regulations provide for penalties by reference to penalty units within the meaning of section 110 of the Sentencing Act 1991. The amount of the penalty is to be calculated, in accordance with section 7 of the Monetary Units Act 2004, by multiplying the number of penalty units applicable by the value of a penalty unit. In accordance with section 11 of the Monetary Units Act 2004, the value of a penalty unit for the financial year commencing 1 July 2012 is $140.84. The amount of the calculated penalty may be rounded to the nearest dollar. The value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004.
