No. 11/2013 Crimes (Controlled Operations) Act 2004 Crimes (Controlled Operations) Amendment Regulations 2013 The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations: Dated: 5 February 2013 Responsible Minister: ROBERT CLARK Attorney-General MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Crimes (Controlled Operations) Regulations 2008 to reflect the transfer of the powers and functions of the Office of Police Integrity and the Director, Police Integrity under the Crimes (Controlled Operations) Act 2004 to the Independent Broad- based Anti-corruption Commission and the Commissioner by the Integrity and Accountability Legislation Amendment Act 2012. 2 Authorising provision These Regulations are made under section 47 of the Crimes (Controlled Operations) Act 2004. -- 2 of 5 -- S.R. No. 11/2013 Crimes (Controlled Operations) Amendment Regulations 2013 2 Authorised by the Chief Parliamentary Counsel 3 Commencement (1) These Regulations (except regulation 7) come into operation on 10 February 2013. (2) Regulation 7 comes into operation on the day on which Part 8 of the Integrity and Accountability Legislation Amendment Act 2012 comes into operation. 4 Principal Regulations In these Regulations, the Crimes (Controlled Operations) Regulations 2008 1 are called the Principal Regulations. 5 New regulation 3A inserted After regulation 3 of the Principal Regulations insert— "3A Definitions In these Regulations— Chief Executive Officer means the person appointed under section 27 of the Independent Broad-based Anti-corruption Commission Act 2011; Deputy Commissioner has the same meaning as it has in the Independent Broad-based Anti-corruption Commission Act 2011; IBAC Officer has the same meaning as it has in the Independent Broad-based Anti- corruption Commission Act 2011.". r. 3 -- 3 of 5 -- S.R. No. 11/2013 Crimes (Controlled Operations) Amendment Regulations 2013 3 Authorised by the Chief Parliamentary Counsel 6 Regulations 5 and 6 substituted For regulations 5 and 6 of the Principal Regulations substitute— "5 IBAC law enforcement officers For the purposes of paragraph (b) of the definition of law enforcement officer in section 3 of the Crimes (Controlled Operations) Act 2004, the following positions and classes of employees are prescribed— (a) the position of Commissioner; (b) the position of Deputy Commissioner; (c) the position of Chief Executive Officer; (d) IBAC Officers classified as Executive Officers; (e) IBAC Officers classified as non- executive employees Grade 4, 5 or 6 or Senior Technical Specialists. 6 Prescribed IBAC Officers For the purposes of the definition of prescribed IBAC Officer in section 3 of the Crimes (Controlled Operations) Act 2004, the following positions are prescribed— (a) the position of Deputy Commissioner; (b) the position of Chief Executive Officer.". 7 Renumbering In regulation 3A of the Principal Regulations, in the definition of Chief Executive Officer for "section 27" substitute "section 33". ═══════════════ r. 6 -- 4 of 5 -- S.R.
