Financial Agreement Act 1994
An Act to approve an agreement entered into between the Commonwealth, the States and the Territories and for related purposes [Royal Assent 10 November 1994]
Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
1.
Short title
This Act may be cited as the
Financial Agreement Act 1994 .
2.
Commencement
This Act commences on a day to be proclaimed.
3.
Interpretation
In this Act, unless the contrary intention appears,
Agreement
means the Agreement, a copy of which is set out in
Schedule 1 .
4.
Approval of Agreement
The
Agreement
is approved.
5.
Implementation of Agreement
(1)
The Treasurer is authorized, empowered and required to do all things necessary or expedient to implement the
Agreement .
(2)
The laws of the State are
(a) modified so far as may be necessary to give full effect to the
Agreement ; and
(b) to be construed subject to any such modification.
(3)
In this section,
law of the State
means any Act of the Parliament of the State and any subordinate legislation made under any such Act.
6.
Administration of Act
Until provision is made in relation to this Act by order under
section 4 of the
Administrative Arrangements Act 1990
(a) the administration of this Act is assigned to the Treasurer; and
(b) the Department responsible to the Treasurer in relation to the administration of this Act is the Department of Treasury and Finance.
