No. 4/2013 Members of Parliament (Register of Interests) Act 1978 Members of Parliament (Register of Interests) Regulations 2013 The Governor in Council makes the following Regulations: Dated: 29 January 2013 Responsible Minister: TED BAILLIEU Premier MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe the forms of return to be completed by Members of Parliament to lodge their register of interests returns. 2 Authorising provision These Regulations are made under section 11 of the Members of Parliament (Register of Interests) Act 1978. 3 Commencement These Regulations come into operation on 29 January 2013. 4 Revocation The Members of Parliament (Register of Interests) Regulations 2003 1 are revoked. -- 2 of 8 -- S.R. No. 4/2013 Members of Parliament (Register of Interests) Regulations 2013 2 Authorised by the Chief Parliamentary Counsel 5 Definitions In these Regulations— return means a primary return or an ordinary return; the Act means the Members of Parliament (Register of Interests) Act 1978. 6 Primary return A primary return to be submitted to the Clerk of the Parliaments under section 5 of the Act must be in the form set out in Schedule 1. 7 Ordinary return An ordinary return to be submitted to the Clerk of the Parliaments under section 5 of the Act must be in the form set out in Schedule 2. 8 Signing and witnessing a return (1) The member to whom a return relates must, in the presence of a witness, sign the return and each page attached to it. No. 4/2013 Members of Parliament (Register of Interests) Regulations 2013 3 Authorised by the Chief Parliamentary Counsel SCHEDULES SCHEDULE 1 PARLIAMENT OF VICTORIA FORM OF PRIMARY RETURN Notes: 1 Section 6(1) of the Members of Parliament (Register of Interests) Act 1978 sets out the information required in a primary return. 2 income source is defined in section 4 of the Members of Parliament (Register of Interests) Act 1978. 3 If there is not sufficient space on this form for all of the information you are required to register, you may attach additional pages for that purpose. Each additional page must be dated, signed by you and by the person witnessing your signature on this form. 4 Please complete this form in typed form or block capitals. Registrable Interests Details 1 Any income source which you have, or expect to have, in the 12 months after the date of this return. 2 The name of any company or other body in which you hold an office as director or otherwise at the date of this return. 3 The name or description of any company, partnership, association or other body in which you hold a beneficial interest exceeding $500 in value. No. 4/2013 Members of Parliament (Register of Interests) Regulations 2013 4 Authorised by the Chief Parliamentary Counsel Registrable Interests Details 4 The name of any political party, body or association or trade or professional organisation of which you are a member at the date of this return. 5 A concise description of any trust in which you hold a beneficial interest. 6 A concise description of any trust of which you are trustee and in which a member of your family holds a beneficial interest. 7 The address or description of any land in which you hold a beneficial interest (other than by way of security for a debt). 8 Any other substantial interest (whether of a pecuniary nature or not) held by you or a member of your family of which you are aware and that you consider might appear to raise a material conflict with your public duty as a Member. No. 4/2013 Members of Parliament (Register of Interests) Regulations 2013 6 Authorised by the Chief Parliamentary Counsel Registrable Interests Details 4 The name of any political party, body or association or trade or professional organisation of which you are, or have been, a member during the return period. 5 A concise description of any trust in which you hold a beneficial interest. 6 A concise description of any trust of which you are trustee and in which a member of your family holds a beneficial interest. 7 The address or description of any land in which you hold a beneficial interest (other than by way of security for a debt). 8 The source of any significant contribution made in cash or kind to travel undertaken by you beyond Victoria during the return period (but not including contributions by the State or a public statutory corporation constituted under a law of the State). 9 Any gift of or exceeding $500 in value received by you from a person other than a relative by blood or marriage. 10 Any other substantial interest (whether of a pecuniary nature or not) held by you or a member of your family of which you are aware and that you consider might appear to raise a material conflict with your public duty as a Member.
