WARNER Governor By Her Excellency's Command, M. T. (RENE) HIDDING Minister for Infrastructure 1. Short title These regulations may be cited as the Marine and Safety (Collision) Regulations 2017 . 2. Commencement These regulations take effect on 4 July 2017. 3. Interpretation In these regulations – International Regulations means the International Regulations for Preventing Collisions at Sea 1972 issued by the International Maritime Organization, as amended from time to time. 4. Adoption of International Regulations The International Regulations, together with any notes included in the International Regulations, are adopted as regulations for the purposes of the Marine and Safety Authority Act 1997 . 5. Offence to contravene International Regulations A person must not contravene a provision of the International Regulations as adopted under regulation 4 . Penalty: Fine not exceeding 50 penalty units. 6. Revocation of distress signals (1) This regulation applies if the master of a vessel transmits, or causes or allows the transmission of, an international distress signal from the vessel but later determines that the vessel is no longer in need of assistance. (2) As soon as practicable after determining that the vessel is no longer in need of assistance, the master of the vessel must transmit a message revoking the international distress signal or cause such a message to be transmitted. Penalty: Fine not exceeding 50 penalty units. (3) For the purposes of subregulation (2) , a message revoking an international distress signal is not taken to have been transmitted until the message has been acknowledged by a coast station. (4) In this regulation – international distress signal means a distress signal prescribed in Annex IV of the International Regulations; transmit means transmit by means of a ship radio.
