WARNER Governor By Her Excellency's Command, ELISE ARCHER Minister for Justice 1. Short title These regulations may be cited as the Births, Deaths and Marriages Registration Regulations 2019 . 2. Commencement These regulations take effect on 5 September 2019. 3. Interpretation In these regulations – Act means the Births, Deaths and Marriages Registration Act 1999 . 4. Prescribed persons For the purposes of section 46(3)(c) and (10) of the Act, the following persons are prescribed: (a) the spouse, or a former spouse, of the person to whom the birth certificate relates (the registered person ); (b) a person who is, or has been, in a significant relationship, within the meaning of the Relationships Act 2003 , with the registered person; (c) a parent of the registered person; (d) an executor or administrator of the registered person’s estate; (e) a person who holds a power of attorney in respect of the registered person; (f) an agent of the registered person who has the written consent of the registered person; (g) an officer or person acting on behalf of a court, or a law enforcement body, of the State, another State, a Territory or the Commonwealth. 5. Fees (1) The fees set out in Schedule 1 are prescribed as the fees that are payable under the Act in respect of the matters to which they respectively relate. (2) The Registrar and a person who asks for a service that is not referred to in Schedule 1 may negotiate and fix the fee that is payable by the person for the service. 6. Legislation rescinded The legislation specified in Schedule 2 is rescinded. SCHEDULE 1 - Fees Regulation 5 Fee (Fee units) 1. A search of the Register in any one name (including the issue of the relevant document) – (a) for a period not exceeding 5 years; and 31 (b) for each additional 5-year period or part of such a period 11 2. The issue of a decorative certificate 17 3. The issue of a medical practitioner’s certificate of cause of death 31 4. A certified copy of an entry or document not otherwise provided for 31 5. Priority fee for processing a request on the same day (in addition to any other fee payable) 22 6. An application to register a change of name, including noting the new name in the Register in this State, or advising the relevant registry in another State in which the person’s birth is registered, and the issue of a change of name certificate 121 7. An application for the amendment of information in the Register not otherwise provided for (not including the issue of a replacement certificate) 33 8. The addition to the Register of details of either parent or of a parent’s marriage 121 9.
