No. 84/2013 Parliamentary Salaries and Superannuation Act 1968 Parliamentary Salaries and Superannuation (Provision of Motor Vehicles) Regulations 2013 The Governor in Council makes the following Regulations: Dated: 25 June 2013 Responsible Minister: DENIS NAPTHINE Premier MATTHEW McBEATH Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to allow for the provision of motor vehicles to members of Parliament. 2 Authorising provision These Regulations are made under section 8A of the Parliamentary Salaries and Superannuation Act 1968. 3 Commencement These Regulations come into operation on 1 July 2013. 4 Revocation The Parliamentary Salaries and Superannuation (Provision of Vehicles) Regulations 2006 1 are revoked. -- 2 of 6 -- S.R. No. 84/2013 Parliamentary Salaries and Superannuation (Provision of Motor Vehicles) Regulations 2013 2 Authorised by the Chief Parliamentary Counsel 5 Definition In these Regulations— term of Parliament means the period commencing on the day of a general election and ending on the day before the next general election, irrespective of the number of sessions of Parliament held between those general elections. 6 Election in relation to a motor vehicle (1) Within one month of— (a) becoming a member; or (b) the commencement of each subsequent term of Parliament— a member may elect in writing to the relevant Presiding Officer to be provided with a motor vehicle under these Regulations. (2) An election under subregulation (1), once made (or taken to be made), may not be revoked in that term of Parliament. (3) A member who was provided (or is taken to have been provided) with a motor vehicle under these Regulations for the immediately preceding term of Parliament will be deemed to have made an election under subregulation (1) unless, within one month of being declared elected for a term of Parliament, the member notifies the relevant Presiding Officer that he or she will not elect to be provided with a motor vehicle under these Regulations for that term of Parliament. (4) A motor vehicle provided to a member under the Parliamentary Salaries and Superannuation (Provision of Vehicles) Regulations 2006 is taken to be provided to the member under these Regulations unless the member makes the notification contemplated by subregulation (5). r. 5 -- 3 of 6 -- S.R. No. 84/2013 Parliamentary Salaries and Superannuation (Provision of Motor Vehicles) Regulations 2013 3 Authorised by the Chief Parliamentary Counsel (5) A member who was provided with a motor vehicle under the Parliamentary Salaries and Superannuation (Provision of Vehicles) Regulations 2006 will be deemed to have made an election under subregulation (1) unless, within two months of the commencement of these Regulations, the member notifies the relevant Presiding Officer that he or she will not elect to be provided with a motor vehicle under these Regulations. 7 Provision of a motor vehicle (1) Subject to subregulation (2), if a member elects to be provided with a motor vehicle under these Regulations— (a) the member will be provided with the use of a four cylinder motor vehicle if the member contributes at the rate of 1·5% of his or her annual basic salary by way of deductions from his or her salary; (b) the member will be provided with the use of a six cylinder motor vehicle if the member contributes at the rate of 2% of his or her annual basic salary by way of deductions from his or her salary. (2) A person will be provided with a motor vehicle under these Regulations until the earlier of that person— (a) ceasing to be a member; or (b) ceasing to make the contributions referred to in subregulation (1); or r. 7 -- 4 of 6 -- S.R. No. 84/2013 Parliamentary Salaries and Superannuation (Provision of Motor Vehicles) Regulations 2013 4 Authorised by the Chief Parliamentary Counsel (c) notifying the relevant Presiding Officer under regulation 6(3) or 6(5) that he or she will not elect to be provided with a motor vehicle under these Regulations. Note The Minister may make guidelines under section 8B of the Parliamentary Salaries and Superannuation Act 1968 which provide for, among other things, policies and procedures in relation to— • the type of motor vehicles provided; • the costs associated with the motor vehicle; • the permitted uses of the motor vehicle; • the authorised drivers of the motor vehicle; and • the responsibilities of the member in relation to the motor vehicle. ═══════════════ r. 7 -- 5 of 6 -- S.R.
