[Regulation 2 inserted: Gazette 22 Sep 2006 p. 4109.] [ 3. Deleted: Gazette 22 Sep 2006 p. 4109.] 4 .Prescribed forms (1)The application forms referred to in the first column hereunder shall be used for the purpose respectively specified in relation thereto in the second column. (2)The form of licence referred to in the first column hereunder shall be used for the purposes respectively specified in relation thereto in the second column. (3)Where the transfer of a licence is consented to or ordered under the Act the order to be endorsed on the original licence shall be in the form of Form 10. 5 .Application to be made with prescribed fee An application for the grant, renewal or transfer of a licence shall be made to the Commissioner and shall be accompanied by the prescribed fee. Deleted: Gazette 18 Nov 2014 p. 4317.] 8 .Form of Register The Register to be kept for the purposes of section 27 of the Act shall be in the form of Form 12. [ 9. Deleted: Gazette 30 Dec 2004 p. 6918.] 10 .Prescribed fees [(1AA)deleted] (1)The fee payable for a matter set out in Schedule 3 column 1 is the fee set out opposite the matter in column 2. (1a)For the purposes of section 13 of the Act, (and subject to the transitional provisions in section 15 of the Business Licensing Amendment Act 1995 ), the following periods are prescribed — (a)section 13(1) — a licence should not exceed 3 years in duration; (b)section 13(1b) — a licence may be renewed for 3 years. (1B)The penalty prescribed under section 13(2) of the Act for any late application for the renewal of a licence is $100.00. Deleted: SL 2021/86 r. 33.] 11 .Offence A person shall not make a false or misleading statement in any application made for the purposes of the Act. 12 .Infringement notices (1)The offences specified in Schedule 2 are offences for which an infringement notice may be issued under Part 2 of the Criminal Procedure Act 2004 . (2)The modified penalty specified opposite an offence in Schedule 2 is the modified penalty for that offence for the purposes of section 5(3) of the Criminal Procedure Act 2004 . (3)The Commissioner may, in writing, appoint persons or classes of persons to be authorised officers or approved officers for the purposes of Part 2 of the Criminal Procedure Act 2004 . (4)The Commissioner is to issue to each authorised officer a certificate, badge or identity card identifying the officer as a person authorised to issue infringement notices. (5)For the purposes of the Criminal Procedure Act 2004  — (a)an infringement notice is to be in the form of Form 13; and (b)a withdrawal of infringement notice is to be in the form of Form 14.
