No. 135/2013 Road Safety Act 1986 Road Safety (Drivers) and (General) Amendment (Mobile Phones and Other Devices) Regulations 2013 The Governor in Council makes the following Regulations: Dated: 29 October 2013 Responsible Minister: TERRY MULDER Minister for Roads YVETTE CARISBROOKE Clerk of the Executive Council PART 1—PRELIMINARY 1 Objectives The objectives of these Regulations are— (a) to amend the Road Safety (Drivers) Regulations 2009— (i) to increase the demerit points that can be recorded against a person for an offence relating to the use of a mobile phone; and (ii) to prescribe the demerit points that can be recorded against a person for an offence relating to the use of a television receiver or a visual display unit; and -- 2 of 6 -- Part 1—Preliminary Road Safety (Drivers) and (General) Amendment (Mobile Phones and Other Devices) Regulations 2013 S.R. No. 135/2013 2 Authorised by the Chief Parliamentary Counsel (b) to amend the Road Safety (General) Regulations 2009 to increase the infringement penalty relating to the use of a mobile phone, television receiver or visual display unit. 2 Authorising provision These Regulations are made under section 95 of the Road Safety Act 1986. 3 Commencement These Regulations come into operation on 25 November 2013. __________________ r. 2 -- 3 of 6 -- Part 2—Road Safety (Drivers) Regulations 2009 Road Safety (Drivers) and (General) Amendment (Mobile Phones and Other Devices) Regulations 2013 S.R. No. 135/2013 3 Authorised by the Chief Parliamentary Counsel PART 2—ROAD SAFETY (DRIVERS) REGULATIONS 2009 4 Amendment of Schedule 3—demerit points (1) After item 19 of Schedule 3 to the Road Safety (Drivers) Regulations 20091 insert— "19A Drive motor vehicle with TV or visual display unit that is visible to driver or likely to distract another driver RR 299(1) 4". (2) In column 3 of item 20 of Schedule 3 to the Road Safety (Drivers) Regulations 2009, for "3" substitute "4". __________________ r. 4 -- 4 of 6 -- Part 3—Road Safety (General) Regulations 2009 Road Safety (Drivers) and (General) Amendment (Mobile Phones and Other Devices) Regulations 2013 S.R. (2) For item 69 of Schedule 7 to the Road Safety (General) Regulations 2009 substitute— "69 2079 Learner driver or holder of a probationary driver licence using any mobile phone RR 300(1A) 3 penalty units".
