No. 176/2013 Road Safety Act 1986 Road Safety (Vehicles) Amendment (Written-off Vehicles) Regulations 2013 The Governor in Council makes the following Regulations: Dated: 17 December 2013 Responsible Minister: TERRY MULDER Minister for Roads YVETTE CARISBROOKE Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Road Safety (Vehicles) Regulations 2009— (a) to prescribe the class of vehicles to be included on the register of written-off vehicles; and (b) to prescribe the information that may be obtained in a certified extract from the register of written-off vehicles; and (c) to specify the circumstances in which vehicles that are repairable write-offs due to cosmetic hail damage may be registered. 2 Authorising provision These Regulations are made under section 95 of the Road Safety Act 1986. -- 2 of 6 -- S.R. No. 176/2013 Road Safety (Vehicles) Amendment (Written-off Vehicles) Regulations 2013 2 Authorised by the Chief Parliamentary Counsel 3 Commencement (1) These Regulations (except regulation 5 and regulation 6) come into operation on the day on which they are made. (2) Regulation 5 comes into operation on the day on which section 17 of the Road Legislation Amendment (Use and Disclosure of Information and Other Matters) Act 2013 comes into operation. (3) Regulation 6 comes into operation on the day on which Part 2 of the Road Legislation Amendment (Use and Disclosure of Information and Other Matters) Act 2013 comes into operation. 4 Principal Regulations In these Regulations, the Road Safety (Vehicles) Regulations 2009 1 are called the Principal Regulations. 5 New regulation 93A inserted After regulation 93 of the Principal Regulations insert— "93A Register of written-off vehicles For the purposes of section 16D(1) of the Act, the vehicles that must be included on the register of written-off vehicles are light motor vehicles that are not more than 15 years old at the date that a determination is made under section 16C(1)(b) of the Act.". r. 3 -- 3 of 6 -- S.R. No. 176/2013 Road Safety (Vehicles) Amendment (Written-off Vehicles) Regulations 2013 3 Authorised by the Chief Parliamentary Counsel 6 Disclosure of information on the register of written- off vehicles For regulation 96 of the Principal Regulations substitute— "96 Certified extract of information from the register of written-off vehicles On payment of the appropriate fee, a person may obtain a certified extract of the following information that has been entered on, or derived from, the register of written- off vehicles— (a) the date of the most recent determination under section 16C(1)(b) of the Act in relation to a vehicle; and (b) any information entered in, or derived from, the register of written-off vehicles that relates to the nature or extent of damage to any vehicle; and (c) a description of the type of write-off applicable to a vehicle entered on the register.". 7 New regulation 97A After regulation 97 of the Principal Regulations insert— "97A Register and renewal of registration of repairable write-off where cosmetic hail damage only (1) This regulation applies to a vehicle that has a vehicle identifier that is the same as the vehicle identifier of a vehicle that is entered on the register of written-off vehicles as a repairable write-off due to the vehicle having sustained only cosmetic damage as a result of the direct impact of hail stones. r. 6 -- 4 of 6 -- S.R. No. 176/2013 Road Safety (Vehicles) Amendment (Written-off Vehicles) Regulations 2013 4 Authorised by the Chief Parliamentary Counsel (2) Despite regulation 97, the Corporation may register a vehicle to which this regulation applies if all the requirements of these Regulations for registration have been satisfied in relation to that vehicle.". 8 Cancellation of registration of written-off vehicles After regulation 119(1) of the Principal Regulations insert— "(1A) Despite subregulation (1), the Corporation is not required to cancel the registration of a vehicle to which regulation 97A applies.". ═══════════════ r. 8 -- 5 of 6 -- S.R.
