Part 2 Prescribed matters 4 Application fees For sections 12(4)(b), 15(4)(c) and 20B(5) of the Act, the fee for an application of a type specified in Schedule 1 is the fee specified opposite in Schedule 1. -- 3 of 12 -- Part 2 Prescribed matters Architects Regulations 2025 2 5 Prescribed insurance policy requirements For section 4A(1)(b) of the Act, a prescribed insurance policy must be: (a) professional indemnity insurance; and (b) for a minimum amount of $1 000 000. 6 Architects exempt from prescribed insurance policy requirements (1) For section 17(4) of the Act, the following classes of registered architect are exempt from the prescribed insurance policy requirements: (a) an architect who is employed by a Commonwealth, State or Territory government; (b) an architect who: (i) is not practising as an architect in Australia or providing architectural services in Australia; and (ii) has notified the Board, in the approved form, that the architect is not practising as an architect in Australia or providing architectural services in Australia. Examples for subregulation (1)(b) An architect who is retired, practising overseas, on parental leave, unemployed or employed outside of the architectural sector. (2) The exemption under subregulation (1)(a) only applies in relation to work done by the architect in the course of the architect's duties as an employee of the government. (3) An architect ceases to be exempt under subregulation (1)(b) if the architect recommences the practise of architecture in Australia or the provision of architectural services in Australia. 7 Continuing professional development requirements For section 18(1) of the Act, the continuing professional development requirements set out in Schedule 2 are prescribed. -- 4 of 12 -- Part 3 Repeals Architects Regulations 2025 3 8 Architects exempt from continuing professional development requirements (1) For section 18(2) of the Act, an architect who does not practise as an architect in Australia or provide architectural services in Australia for an entire registration year is exempt from the continuing professional development requirements in relation to that registration year. Examples for subregulation (1) An architect who is retired, practising overseas, on parental leave, unemployed or employed outside the architectural sector. (2) An architect who is exempt under subregulation (1) must, at the end of each registration year in relation to which the architect is exempt under that subregulation, notify the Board, in the approved form, that the architect did not practise as an architect in Australia or provide architectural services in Australia during that registration year. 9 Grounds for cancellation of registration of architect For section 20(h) of the Act, the following conduct is prescribed: (a) conduct that contravenes or fails to comply with any code of professional conduct that is applicable to the architect; (b) conduct that renders the architect ineligible for registration as an architect under section 13 of the Act. CPD means continuing professional development. CPD activity means a formal CPD activity or an informal CPD activity. CPD obligation means an architect's obligation under clause 4 to accrue CPD points for a registration year. CPD point, see clause 2. formal CPD activity, see clause 3(1). informal CPD activity, see clause 3(2). 2 CPD points (1) An architect accrues points (CPD points) for participating in CPD activities. (2) An architect accrues CPD points at a rate of 0.5 points per 30 minutes of undertaking CPD activities. -- 8 of 12 -- Schedule 2 CPD requirements Architects Regulations 2025 7 3 CPD activities (1) A formal CPD activity is, subject to subclauses (3) and (4), any of the following: (a) attending (including by videoconference) a talk, seminar, lecture or workshop conducted by a person with practical or academic experience in the subject covered; (b) preparing and conducting (including by videoconference) a talk, seminar, lecture or workshop; (c) developing a course or curriculum of architecture at a tertiary level; (d) writing an article, book or paper for publication; (e) undertaking an assessment task as part of a tertiary-level architectural course. Examples for subclause (1)(e) Sitting an exam, writing an essay or designing a structure for assessment. (2) An informal CPD activity is, subject to subclauses (3) and (4), any of the following: (a) self-directed study involving materials specifically aimed at increasing or updating the knowledge or skills of architects; (b) participating in structured visits to building sites, buildings and exhibitions; (c) participating in a mentoring program for architects; (d) tutoring in architecture at a tertiary level; (e) marking work produced by architecture students at a tertiary level; (f) participating as an examiner or assessor for the Architectural Practice Examination or other examination required for registration as an architect; (g) serving on a committee, panel or advisory group of an architectural professional association, regulatory authority or government body. Examples for subclause (2)(a) Reading articles, listening to podcasts or watching videos. -- 9 of 12 -- Schedule 2 CPD requirements Architects Regulations 2025 8 (3) A CPD activity must: (a) be of significant intellectual or practical content; and (b) relate to a competency area; and (c) be relevant to the architect's immediate or long-term professional development needs. (4) Engaging in architectural practise and providing architectural services are not CPD activities. 4 CPD obligation (1) In each registration year, an architect must accrue 20 CPD points. (2) At least 10 CPD points must be accrued from formal CPD activities. (3) At least 1 CPD point must be accrued in each competency area. 5 Fraction of CPD point The only fraction of a CPD point that may be claimed is 0.5 points. 6 Record of compliance An architect must, by the end of each registration year, give to the Board, in the approved form, a record of the architect's compliance with the architect's CPD obligation for that year. 7 Board may require information (1) The Board may, by written notice, require an architect to give it information about the architect's compliance with the architect's CPD obligation.
