NORTHERN TERRITORY OF AUSTRALIA POLICE ADMINISTRATION (FEES) REGULATIONS 1985 As in force at 31 July 2024 Table of provisions 1 Citation ............................................................................................ 1 2 Fee payable for member of Police Force appearing as witness in civil action .................................................................................... 1 2A Fee for police attendance at false alarms ........................................ 2 3 Other fees ........................................................................................ 2 Schedule Fees for provision of other services ENDNOTES -- 1 of 11 -- -- 2 of 11 -- NORTHERN TERRITORY OF AUSTRALIA ____________________ As in force at 31 July 2024 ____________________ POLICE ADMINISTRATION (FEES) REGULATIONS 1985 Regulations under the Police Administration Act 1978 1 Citation These Regulations may be cited as the Police Administration (Fees) Regulations 1985. 2 Fee payable for member of Police Force appearing as witness in civil action (1) The prescribed fee, under section 167(2) of the Act, for a member of the Police Force appearing before a court as a witness at the hearing of a civil proceeding is: (a) half of the member's daily salary (as determined from time to time by the Tribunal under Part III of the Act) for each half day or part thereof occupied in travelling from the place where that member is stationed to the Court, attending the court and returning from the court to that place; (b) the cost of the member's conveyance from the place where that member is stationed to the court and the return to that place; and (c) for each day of the hearing – the cost of meals; or (d) for each night that the member is obliged, because of the hearing, to stay away from that member's station – travelling allowance (as determined from time to time under the Act). (2) A member's salary referred to in subregulation (1) shall be calculated: (a) for one day – by dividing the member's gross normal fortnightly salary by 10; or (b) for one half day – by dividing the member's gross normal fortnightly salary by 20. -- 3 of 11 -- Police Administration (Fees) Regulations 1985 2 (3) A member shall not demand from the person calling him as a witness, the payment of overtime. 2A Fee for police attendance at false alarms (1) Subject to subregulations (2) and (3), where the police have attended any premises in response to a false alarm on 3 occasions in a period of 28 days, an attendance fee of 200 revenue units shall, on each subsequent occasion on which they so attend the premises, be payable by the occupier of the premises or, if they are unoccupied, by their owner, and shall be recoverable as a debt due and payable to the Territory. (2) Where in the case of any premises a period of 90 days passes during which the police have not attended them in response to a false alarm, all previous occasions on which the police have attended the premises shall be disregarded for the purposes of subregulation (1). (3) A fee shall not become payable under subregulation (1) if the Commissioner so decides in the circumstances of a particular case. (4) For the purposes of this regulation, the police are to be treated as attending premises in response to a false alarm where a member of the Police Force attends them in the course of his duty and in response to an alarm which was installed for the protection of the premises and was, in the opinion of the member responsible for the investigation of the incident, activated otherwise than by a person's unlawful conduct. 3 Other fees (1) The fees specified in Column 2 of the Schedule are fees for the other services (which may be provided by the Police Force) specified in Column 1 of the Schedule. (2) A fee shall not be charged for services provided in respect of a sporting or entertainment event except where more than 2 members are present at the event to carry out duties. (3) For the purposes of this regulation and the Schedule: for each half hour or part thereof means the period of time during which services are provided in respect of a sporting or entertainment event calculated forward to or back to the nearest half hour. -- 4 of 11 -- Police Administration (Fees) Regulations 1985 3 services provided in respect of a sporting or entertainment event means the carrying out of duties by members, or the provision of support services, for and in relation to the holding of a sporting or entertainment event and, in particular, includes: (a) policing the area, whether or not an enclosed area, where the event is to take place; (b) policing an area designated as a car park, controlling traffic at an entrance to or exit from the event or designated car park and controlling traffic which is using routes specified to be used in relation to the event; (c) policing the immediate vicinity outside the area where the event is to take place; and (d) planning and administering a strategy in relation to the event. sporting or entertainment event means a sports or other event organised or promoted for the purpose of making a profit except where the Commissioner is satisfied that the whole of any profit is to be applied to a purpose that is charitable, benevolent, philanthropic or beneficial to the community. support service means a police aircraft, a police car, a police horse, a police motorboat, a police motorcycle or a police van provided to enable a member to carry out duties in respect of a sports or entertainment event, but does not include a vehicle used only to transport a member to the area where the member will carry out those duties. travelling time means the period of time reasonably taken: (a) by a member to travel from a police station;
