NORTHERN TERRITORY OF AUSTRALIA PUBLIC TRANSPORT (PASSENGER SAFETY) REGULATIONS 2008 As in force at 21 January 2026 Table of provisions 1 Citation ............................................................................................ 1 2 Commencement .............................................................................. 1 3 Disqualifying offences ...................................................................... 1 4 Transit officers to familiarise with code of conduct .......................... 1 Schedule Disqualifying offences ENDNOTES -- 1 of 7 -- -- 2 of 7 -- NORTHERN TERRITORY OF AUSTRALIA ____________________ As in force at 21 January 2026 ____________________ PUBLIC TRANSPORT (PASSENGER SAFETY) REGULATIONS 2008 Regulations under the Public Transport (Passenger Safety) Act 2008 1 Citation These Regulations may be cited as the Public Transport (Passenger Safety) Regulations 2008. 2 Commencement These Regulations commence on the commencement of the Public Transport (Passenger Safety) Act 2008. 3 Disqualifying offences For the definition of disqualifying offence in section 3 of the Act, the disqualifying offences are: (a) an offence set out in the Schedule; and (b) an offence under a law of another jurisdiction which, if it had been committed in the Territory, would have constituted an offence of a kind mentioned in paragraph (a); and (c) any other offence, whether committed in the Territory or elsewhere, for which the offender was sentenced to a term of imprisonment, whether or not the imprisonment was suspended in whole or in part. 4 Transit officers to familiarise with code of conduct (1) A transit officer must familiarise himself or herself with the requirements of the code of conduct. (2) If a transit officer has doubt about the meaning or application of the code, the officer must consult his or her supervisor for guidance as soon as reasonably practicable. (3) Transit officers must acknowledge in writing that they have received a copy of the code, have read it and understand their obligations under it. -- 3 of 7 -- Schedule Disqualifying offences Public Transport (Passenger Safety) Regulations 2008 2 Schedule Disqualifying offences regulation 3 Part A – Criminal Code and Misuse of Drugs Act 1990 1 An indictable offence under the Criminal Code or the Misuse of Drugs Act 1990 (whether the charge of the offence is dealt with summarily or on indictment). 2 An offence against section 71, 80(1), 81(1) or (3), 109, 121, 125C, 126, 188(1), 199, 200 or 208NA of the Criminal Code. 2A An offence against section 82(1) of the Criminal Code as in force before the commencement of Part 3 of the Independent Commissioner Against Corruption (Consequential and Related Amendments) Act 2018. 3 An offence against section 213(1) of the Criminal Code, as in force immediately before the commencement of section 10 of the Criminal Code Amendment (Property Offences) Act 2022. 3A An offence against section 133 or 140 of the Criminal Code as in force before the commencement of Part 2 of the Criminal Justice Legislation Amendment (Sexual Offences) Act 2023. 4 An offence committed before the commencement of the Criminal Code Act 1983 which would, if committed after that commencement, have constituted an indictable offence under the Criminal Code or an offence mentioned in item 2. 5 An offence committed before the commencement of the Misuse of Drugs Act 1990 which would, if committed after that commencement, have constituted an indictable offence under the Misuse of Drugs Act 1990. Part B – Firearms Act 1997 An offence against section 34(5), 39(2), 40(6), 42(2), 43(2), 58, 59, 62, 63, 67, 71, 77, 78, 82, 83, 84, 85, 86 or 89 of the Firearms Act 1997. Part C – Weapons Control Act 2001 An offence against section 6, 7 or 8 of the Weapons Control Act 2001. Part D – Summary Offences Act 1923 An offence against section 46A, 47, 47AA, 47AB, 47A, 47B, 49A, 50, 53, 55, 56, 60, 60A, 61, 68A, 69A or 69B of the Summary Offences Act 1923. -- 4 of 7 -- Schedule Disqualifying offences Public Transport (Passenger Safety) Regulations 2008 3 Part E – Domestic and Family Violence Act 2007 An offence against section 120(1) of the Domestic and Family Violence Act 2007.
