NORTHERN TERRITORY OF AUSTRALIA TERRITORY PARKS AND WILDLIFE CONSERVATION (JUDBARRA / GREGORY NATIONAL PARK CARBON EMISSIONS REDUCTION PROJECT) BY-LAWS 2022 As in force at 3 November 2022 Table of provisions 1 Title .................................................................................................. 1 2 Commencement .............................................................................. 1 3 Definitions ........................................................................................ 1 4 Application of By-laws ..................................................................... 2 5 Use of fire for carbon emissions reduction....................................... 2 6 Trade and commerce ...................................................................... 3 ENDNOTES -- 1 of 6 -- -- 2 of 6 -- NORTHERN TERRITORY OF AUSTRALIA ____________________ As in force at 3 November 2022 ____________________ TERRITORY PARKS AND WILDLIFE CONSERVATION (JUDBARRA / GREGORY NATIONAL PARK CARBON EMISSIONS REDUCTION PROJECT) BY-LAWS 2022 By-laws under the Territory Parks and Wildlife Conservation Act 1976 1 Title These By-laws may be cited as the Territory Parks and Wildlife Conservation (Judbarra / Gregory National Park Carbon Emissions Reduction Project) By-laws 2022. 2 Commencement These By-laws commence on the day on which they are notified in the Gazette. 3 Definitions In these By-laws: Judbarra / Gregory National Park means land to which by-law 4 applies. use of fire includes the following activities: (a) intentionally lighting fires; (b) slashing; (c) grading; (d) fire suppression; (e) any other form of fire management. -- 3 of 6 -- Territory Parks and Wildlife Conservation (Judbarra / Gregory National Park Carbon Emissions Reduction Project) By-laws 2022 2 4 Application of By-laws These By-laws apply in relation to: (a) all the areas of land declared to be a park under section 24(2) of the Territory Parks and Wildlife Conservation Act 1976 by instrument dated 10 September 2009 and published in Gazette G38 on 23 September 2009; and (b) the parcel of land known as Gregory's Tree Historical Reserve declared to be a reserve under section 24(2) of the Territory Parks and Wildlife Conservation Act 1976 by instrument dated 10 September 2009 and published in Gazette G38 on 23 September 2009. 5 Use of fire for carbon emissions reduction (1) By-laws 11(1) and (2) and 11A(2) of the Territory Parks and Wildlife Conservation By-laws 1984 do not apply in relation to use of fire in the Judbarra / Gregory National Park that is: (a) for the purpose of reducing carbon emissions in the Judbarra / Gregory National Park; and (b) carried out during the period commencing on the commencement of this by-law and ending on 1 January 2045; and (c) part of an eligible offsets project declared under section 27(2) of the Carbon Credits (Carbon Farming Initiative) Act 2011 (Cth); and (d) approved by the joint management partners for the Judbarra / Gregory National Park.
