No. 122/2012 Evidence (Miscellaneous Provisions) Act 1958 Evidence (Affidavits and Statutory Declarations) Amendment Regulations 2012 The Governor in Council makes the following Regulations: Dated: 30 October 2012 Responsible Minister: ROBERT CLARK Attorney-General MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Evidence (Affidavits and Statutory Declarations) Regulations 2008 to— (a) replace references to the Evidence Act 1958 with references to the Evidence (Miscellaneous Provisions) Act 1958; (b) update the prescribed classifications of persons in the public service who may witness a statutory declaration or before whom an affidavit may be taken and sworn under sections 107A and 123C of the Evidence (Miscellaneous Provisions) Act 1958. -- 2 of 4 -- S.R. No. 122/2012 Evidence (Affidavits and Statutory Declarations) Amendment Regulations 2012 2 Authorised by the Chief Parliamentary Counsel 2 Authorising provision These Regulations are made under section 152(2) of the Evidence (Miscellaneous Provisions) Act 1958. 3 Commencement These Regulations come into operation on 5 November 2012. 4 Update of references to the Evidence Act 1958 In regulations 1 and 2 of the Evidence (Affidavits and Statutory Declarations) Regulations 20081 , for "Evidence Act 1958" substitute "Evidence (Miscellaneous Provisions) Act 1958". 5 Prescribed classifications in the public service (1) In regulation 5(1) of the Evidence (Affidavits and Statutory Declarations) Regulations 2008, for "Evidence Act 1958" substitute "Evidence (Miscellaneous Provisions) Act 1958". (2) In regulation 5(1) of the Evidence (Affidavits and Statutory Declarations) Regulations 2008, for paragraphs (g) and (h) substitute— "(g) Child Protection Practitioner CPP 2 to CPP 6 (inclusive); (h) Children Youth and Families CYF 2 to CYF 6 (inclusive);". 6 Prescribed classifications in statutory authorities In regulation 6 of the Evidence (Affidavits and Statutory Declarations) Regulations 2008, for "Evidence Act 1958" substitute "Evidence (Miscellaneous Provisions) Act 1958". ═══════════════ r. 2 -- 3 of 4 -- S.R.
