No. 134/2012 Gambling Regulation Act 2003 Gambling Regulation (Pre-commitment) Regulations 2012 The Governor in Council makes the following Regulations: Dated: 27 November 2012 Responsible Minister: MICHAEL O'BRIEN Minister for Gaming MATTHEW McBEATH Clerk of the Executive Council 1 Objectives The objectives of these Regulations are— (a) to prescribe, for the purposes of section 1.3 of the Gambling Regulation Act 2003, a pre-commitment mechanism that applies to a prescribed gaming machine; and (b) to prescribe, for the purposes of section 3.4.31A of the Gambling Regulation Act 2003, certain gaming machines as prescribed gaming machines. 2 Authorising provision These Regulations are made under section 11.2.1 of the Gambling Regulation Act 2003. -- 2 of 6 -- S.R. No. 134/2012 Gambling Regulation (Pre-commitment) Regulations 2012 2 Authorised by the Chief Parliamentary Counsel 3 Commencement These Regulations come into operation on 30 November 2012. 4 Revocation The Gambling Regulation (Pre-commitment) Interim Regulations 20111 are revoked. 5 Definition In these Regulations— communication protocol means the component, whether computer hardware or software, of a gaming machine type approved by the Commission under section 3.5.4(3) of the Act that is used for the purpose of transmitting data between a gaming machine and an electronic monitoring system; pre-commitment session means the period between when a player who has set a time limit or net loss limit for play on a gaming machine starts to play and when that limit is reached; the Act means the Gambling Regulation Act 2003. 6 Required pre-commitment mechanism For the purposes of the definition of pre-commitment mechanism in section 1.3(1) of the Act, a mechanism or system that does the following is prescribed and applies to a prescribed gaming machine referred to in section 3.4.31A of the Act— (a) allows a person to set a time limit or net loss limit or both before playing a gaming machine; and r. 3 -- 3 of 6 -- S.R. No. 134/2012 Gambling Regulation (Pre-commitment) Regulations 2012 3 Authorised by the Chief Parliamentary Counsel (b) if the person reaches a time limit or net loss limit set under paragraph (a) while playing a gaming machine, causes the following information to be clearly visible to the person while at the gaming machine for at least 15 seconds— (i) cash in, being the total amount (expressed in dollars and cents) the player has put into the gaming machine during the pre-commitment session; (ii) net win or net loss (expressed in dollars and cents) of the player during the pre-commitment session; (iii) duration of the pre-commitment session (expressed in hours and minutes). Examples 1 The following is an example of the information that may be displayed if a player sets a time limit of 30 minutes and reaches that time limit: Cash in $25.00 Net Win or (-Net Loss) (-$2.00) Total time played 31 minutes 2 The following is an example of the information that may be displayed if a player sets a net loss limit of $30 and reaches that net loss limit: Cash in $50.00 (-Net Loss) (-$30.10) Total time played 1 hour and 23 minutes. r. 6 -- 4 of 6 -- S.R. No. 134/2012 Gambling Regulation (Pre-commitment) Regulations 2012 4 Authorised by the Chief Parliamentary Counsel 7 Gaming machines required to have a pre-commitment mechanism (1) Subject to subregulation (2), for the purposes of section 3.4.31A of the Act, a prescribed gaming machine is a gaming machine type approved by the Commission under section 3.5.4(3) of the Act on or after 1 December 2010. (2) If a gaming machine type approved by the Commission under section 3.5.4(3) of the Act on or after 1 December 2010 is the same gaming machine type, except for its communication protocol, that has been approved by the Commission under that section before 1 December 2010, then the gaming machine type is not a prescribed gaming machine. ═══════════════ r. 7 r. 7 -- 5 of 6 -- S.R.
