No. 58/2012 Infringements Act 2006 Infringements (General) Amendment (Further Lodgeable Infringement Offences) Regulations 2012 The Governor in Council makes the following Regulations: Dated: 28 June 2012 Responsible Minister: ROBERT CLARK Attorney-General YVETTE CARISBROOKE Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Infringements (General) Regulations 2006 to prescribe certain infringement offences under the Marine (Drug, Alcohol and Pollution Control) Act 1988, the Marine Safety Act 2010, the Port Management Act 1995 and the Sex Work Act 1994 as lodgeable infringement offences for the purposes of the Infringements Act 2006. 2 Authorising provision These Regulations are made under section 168 of the Infringements Act 2006. -- 2 of 10 -- S.R. No. 58/2012 Infringements (General) Amendment (Further Lodgeable Infringement Offences) Regulations 2012 2 Authorised by the Chief Parliamentary Counsel 3 Commencement These Regulations come into operation on 1 July 2012. 4 Principal Regulations In these Regulations, the Infringements (General) Regulations 2006 1 are called the Principal Regulations. 5 Item 7B substituted and new item 7BA inserted— Schedule 4 For item 7B of Schedule 4 to the Principal Regulations substitute— "7B Marine (Drug, Alcohol and Pollution Control) Act 1988 7B.1 Section 28(1)(b). 7BA Marine Safety Act 2010 7BA.1 Sections 37(1), 37(2), 37(3), 46(1), 46(2), 47(1), 47(2), 49(1), 49(2), 50(1), 50(2), 59, 61, 62(1) and 62(2). 7BA.2 Section 63(1) constituted by a failure to comply with regulation 63(2)(a) of the Marine Safety Regulations 2012 in relation to a standard specified in regulations 58(j), 59(b), 60(2)(f) or 61(2)(f) of those Regulations. 7BA.3 Section 63(1) constituted by a failure to comply with regulation 63(2)(d) of the Marine Safety Regulations 2012. 7BA.4 Sections 67(1), 67(2), 73(1), 73(2) and 74. r. 3 -- 3 of 10 -- S.R. No. 58/2012 Infringements (General) Amendment (Further Lodgeable Infringement Offences) Regulations 2012 3 Authorised by the Chief Parliamentary Counsel 7BA.5 Section 197 constituted by a failure to comply with clause 2(a) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. Note Notice is defined in the Transport (Infringements) Regulations 2010 as Notice No. 1 made under section 15(2) of the Marine Act 1988 published in the Government Gazette Number G 26 on 2 July 1998 (pages 1706 to 1824) as amended from time to time. That Notice is taken to be waterway rules under section 342 of the Marine Safety Act 2010. 7BA.6 Section 197 constituted by a failure to comply with clause 2(b) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.7 Section 197 constituted by a failure to comply with clause 2(c) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.8 Section 197 constituted by a failure to comply with clause 3 of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.9 Section 197 constituted by a failure to comply with clause 4(a) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. r. 5 -- 4 of 10 -- S.R. No. 58/2012 Infringements (General) Amendment (Further Lodgeable Infringement Offences) Regulations 2012 4 Authorised by the Chief Parliamentary Counsel 7BA.10 Section 197 constituted by a failure to comply with clause 4(b) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.11 Section 197 constituted by a failure to comply with clause 4(c) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.12 Section 197 constituted by a failure to comply with clause 6(1)(a) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.13 Section 197 constituted by a failure to comply with clause 6(1)(b) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.14 Section 197 constituted by a failure to comply with clause 6(2) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.15 Section 197 constituted by a failure to comply with clause 6(3)(a) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.16 Section 197 constituted by a failure to comply with clause 6(3)(b) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. r. 5 -- 5 of 10 -- S.R. No. 58/2012 Infringements (General) Amendment (Further Lodgeable Infringement Offences) Regulations 2012 7 Authorised by the Chief Parliamentary Counsel 7BA.31 Section 197 constituted by a failure to comply with clause 19(c) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.32 Section 197 constituted by a failure to comply with clause 22 of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.33 Section 197 constituted by a failure to comply with clause 23 of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.34 Section 197 constituted by a failure to comply with clause 23A of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.35 Section 197 constituted by a failure to comply with clause 23B of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act. 7BA.36 Regulations 24(2), 24(3), 24(5), 24(7) and 89 of the Marine Safety Regulations 2012. 7BA.37 Regulations 91(1), 91(2), 92(1), 93, 94(1), 95, 96(1), 96(2), 96(3), 96(4), 96(5), 96(6), 97(1)(a), 97(1)(b), 98(3), 99(2) and 99(3) of the Marine Safety Regulations 2012. 7BA.38 Regulations 100(1), 100(2) and 100(3) of the Marine Safety Regulations 2012. r. 5 -- 8 of 10 -- S.R. No. 58/2012 Infringements (General) Amendment (Further Lodgeable Infringement Offences) Regulations 2012 8 Authorised by the Chief Parliamentary Counsel 7BA.39 Regulations 101(1), 101(2) and 101(3) of the Marine Safety Regulations 2012 in any of the circumstances specified in regulation 101(4)(a), (b), (c), (d) or (e) of those Regulations. 7BA.40 Regulations 102(1), 102(2), 102(3), 103, 104(1), 104(2), 110(1), 110(2), 110(3), 110(4), 110(5), 110(6), 110(7), 110(8), 110(9), 111(1), 111(2), 112(1) and 112(2) of the Marine Safety Regulations 2012.". 6 New item 8B inserted into Schedule 4 After item 8A of Schedule 4 to the Principal Regulations insert— "8B Port Management Act 1995 8B.1 Regulations 206, 207, 208(1), 209(1), 210(1), 210(2), 211(1), 211(2), 300(1), 301(1), 400, 531(3) and 532(3) of the Port Services (Local Ports) Regulations 2004.". 7 Schedule 4 amended—Sex Work Act 1994 (1) In item 12.1 of Schedule 4 to the Principal Regulations— (a) after "Sections" insert "17(1)(a), 17(1)(b), 17(2), 17(3)(a), 17(3)(b), 17(4)(a), 17(4)(b), 21(1)(a), 21(1)(b),"; (b) after "41," insert "52(4), 60A(1),". (2) After item 12.1 of Schedule 4 to the Principal Regulations insert— "12.2 Regulations 7(3), 7(3A) and 7(3B) of the Sex Work Regulations 2006.". ═══════════════ r. 6 -- 9 of 10 -- S.R.
