No. 107/2012 Infringements Act 2006 Infringements (General) Further Amendment (Lodgeable Infringement Offences) Regulations 2012 The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations: Dated: 26 September 2012 Responsible Minister: ROBERT CLARK Attorney-General MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Infringements (General) Regulations 2006 to prescribe certain infringement offences under the Crown Land (Reserves) Act 1978, the Forests Act 1958, the National Parks Act 1975, the Plant Biosecurity Act 2010, the Residential Tenancies Act 1997, the Road Safety Act 1986, the Second-Hand Dealers and Pawnbrokers Act 1989, the Water Act 1989 and the Wildlife Act 1975 as lodgeable infringement offences for the purposes of the Infringements Act 2006. -- 2 of 8 -- S.R. No. 107/2012 Infringements (General) Further Amendment (Lodgeable Infringement Offences) Regulations 2012 2 Authorised by the Chief Parliamentary Counsel 2 Authorising provision These Regulations are made under section 168 of the Infringements Act 2006. 3 Commencement (1) These Regulations, except regulation 7, come into operation on 3 October 2012. (2) Regulation 7 comes into operation on 31 March 2013. 4 Principal Regulations In these Regulations, the Infringements (General) Regulations 2006 1 are called the Principal Regulations. 5 Schedule 3 amended—National Parks Act 1975 (1) In item 8.1 of Schedule 3 to the Principal Regulations for "Section" substitute "Sections 44A(1) and". (2) After item 8.1 of Schedule 3 to the Principal Regulations insert— "8.2 Regulations 63(1), 64(1) and 66(1) of the National Parks (Park) Regulations 2003.". 6 New item 8AA inserted into Schedule 3 After item 8 of Schedule 3 to the Principal Regulations insert— "8AA Plant Biosecurity Act 2010 8AA.1 Sections 9(1), 10(1), 15(1), 15(5), 20(2), 20(3), 25(2), 25(3), 25(4), 26(5), 27(2), 30(5), 33(3), 35(4), 43(4), 45(1), 45(4), 46(1), 98, 104(5) and 111(2). 8AA.2 Regulation 14(2) of the Plant Biosecurity Regulations 2012.". r. 2 -- 3 of 8 -- S.R. No. 107/2012 Infringements (General) Further Amendment (Lodgeable Infringement Offences) Regulations 2012 3 Authorised by the Chief Parliamentary Counsel 7 Schedule 3 amended—Residential Tenancies Act 1997 In item 9.2 of Schedule 3 to the Principal Regulations for "and 127(1)" substitute ", 127(1), 142B(1), 142B(2) and 142B(3)". 8 Schedule 3 amended—Road Safety Act 1986 In item 9A.4 of Schedule 3 to the Principal Regulations, after "128," insert "128A,". 9 Schedule 3 amended—Second-Hand Dealers and Pawnbrokers Act 1989 (1) In item 10.1 of Schedule 3 to the Principal Regulations, after "Sections" insert "11B(a), 11B(b), 11B(c), 11C(4), 12(a), 12(b), 12(c), 12(d), 17(1), 17(2), 18D,". (2) After item 10.1 of Schedule 3 to the Principal Regulations insert— "10.2 Regulations 12, 13(1) and 15(3) of the Second-Hand Dealers and Pawnbrokers Regulations 2008.". 10 Item 12 of Schedule 3 amended—Water Act 1989 (1) For items 12.2 to 12.7 of Schedule 3 to the Principal Regulations substitute— "12.2 Clause 10 of Water Restrictions By-Law No. 190. 12.3 Clause 10 of Model Water Restriction By-Law No. 001/12. 12.4 Clause 10 of Model Water Restriction By-Law No. 7. 12.5 Clause 10 of Model Water Restriction By-Law No. 1/2012. 12.6 Clause 10 of Water Restriction By-Law No. 5. r. 7 -- 4 of 8 -- S.R. (2) For item 12.10 of Schedule 3 to the Principal Regulations substitute— "12.10 Clause 10 of Water Restriction By-Law No. 12.". (3) For items 12.13 to 12.14 of Schedule 3 to the Principal Regulations substitute— "12.13 Clause 10 of Water Restriction By-Law 11/11. 12.14 Clause 10 of Urban Water Restrictions By-Law No. 2. 12.15 Clause 10 of Water Restriction By-Law No. 001/2012. 12.16 Clause 10 of Water Restriction By-Law No. 001/2012. 12.17 Clause 10 of Water Restriction By-Law No. 001/2012.". 11 New item 14 inserted into Schedule 3 After item 13 of Schedule 3 to the Principal Regulations insert— "14 Wildlife Act 1975 14.1 Section 21AA(1).". 12 Schedule 4 amended—Crown Land (Reserves) Act 1978 (1) After item 2A.95 of Schedule 4 to the Principal Regulations insert— "2A.95A Section 13(6) constituted by a contravention of regulation 14(1) of the Crown Land (Reserves) (Phillip Island Nature Park) Regulations 2010.". r. 11 -- 5 of 8 -- S.R. No. 107/2012 Infringements (General) Further Amendment (Lodgeable Infringement Offences) Regulations 2012 5 Authorised by the Chief Parliamentary Counsel (2) After item 2A.103 of Schedule 4 to the Principal Regulations insert— "2A.103A Section 13(6) constituted by a contravention of regulation 18(4) of the Crown Land (Reserves) (Phillip Island Nature Park) Regulations 2010.". (3) After item 2A.111 of Schedule 4 to the Principal Regulations insert— "2A.111A Section 13(6) constituted by a contravention of regulation 27(1)(a) of the Crown Land (Reserves) (Phillip Island Nature Park) Regulations 2010.". (4) After item 2A.112 of Schedule 4 to the Principal Regulations insert— "2A.112A Section 13(6) constituted by a contravention of regulation 27(1)(d) of the Crown Land (Reserves) (Phillip Island Nature Park) Regulations 2010.". (5) After item 2A.114 of Schedule 4 to the Principal Regulations insert— "2A.114A Section 13(6) constituted by a contravention of regulation 33 of the Crown Land (Reserves) (Phillip Island Nature Park) Regulations 2010. 2A.114B Section 13(6) constituted by a contravention of regulation 34(2) of the Crown Land (Reserves) (Phillip Island Nature Park) Regulations 2010.". (6) After item 2A.125 of Schedule 4 to the Principal Regulations insert— "2A.125A Section 13(6) constituted by a contravention of regulation 15 of the Crown Land (Reserves) (Yarra Park) Regulations 2010.". r. 12 -- 6 of 8 -- S.R. (8) After item 2A.150 of Schedule 4 to the Principal Regulations insert— "2A.150A Section 13(6) constituted by a contravention of regulation 30(1)(a) of the Crown Land (Reserves) (Yarra Park) Regulations 2010. 2A.150B Section 13(6) constituted by a contravention of regulation 30(1)(c) of the Crown Land (Reserves) (Yarra Park) Regulations 2010.". (9) After item 2A.156 of Schedule 4 to the Principal Regulations insert— "2A.157 Sections 21L(1), 21R(1), 21S(1), 21X(1), 21X(2) and 21X(4). 2A.158 Regulations 6(1), 6(2), 6(3), 6(4) and 6(5) of the Crown Land (Reserves) (Domestic Firewood) Regulations 2012.". 13 Schedule 4 amended—Forests Act 1958 (1) In item 6A.1 of Schedule 4 to the Principal Regulations, after "Sections" insert "57Q(1), 57W(1), 57X(1), 57ZD(1), 57ZD(2), 57ZD(3),".
