No. 161/2012 Wildlife Act 1975 Wildlife (Game) Amendment Regulations 2012 The Governor in Council makes the following Regulations: Dated: 19 December 2012 Responsible Minister: PETER WALSH Minister for Agriculture and Food Security MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Wildlife (Game) Regulations 2012 to make minor miscellaneous amendments. 2 Authorising provisions These Regulations are made under sections 22A and 87 of the Wildlife Act 1975. 3 Principal Regulations In these Regulations, the Wildlife (Game) Regulations 2012 1 are called the Principal Regulations. -- 2 of 8 -- S.R. No. 161/2012 Wildlife (Game) Amendment Regulations 2012 2 Authorised by the Chief Parliamentary Counsel 4 Definition of secured In regulation 5 of the Principal Regulations, in the definition of secured— (a) in paragraph (a), after "container locked in the boot or" insert "stowed in a"; (b) in paragraph (b), after "in a part of the vehicle" insert "that is". 5 Condition of certain game licences In regulation 22(1)(a) of the Principal Regulations, for "that allows the" substitute "that allows". 6 Power of Secretary to cancel registration of a hound In regulation 25(1)(e) of the Principal Regulations, for "conditions" substitute "condition". 7 Power of Secretary to suspend registration of a hound In regulation 26(1)(e) of the Principal Regulations, for "conditions" substitute "condition". 8 Approved methods for hunting Hog Deer, Chital Deer or Fallow Deer In regulation 35(c) of the Principal Regulations, for "22 kilograms" substitute "20 kilograms". 9 Possession of spotlight and firearm In regulation 36(1), (2) and (3) of the Principal Regulations, for "30 minutes before sunset until 30 minutes after sunrise" substitute "30 minutes after sunset until 30 minutes before sunrise". r. 4 -- 3 of 8 -- S.R. No. 161/2012 Wildlife (Game) Amendment Regulations 2012 3 Authorised by the Chief Parliamentary Counsel 10 Prohibited deer hunting areas (1) In regulation 71(1) of the Principal Regulations, for "indicated by" substitute "shown by". (2) At the foot of regulation 71(1) of the Principal Regulations insert— "Penalty: 20 penalty units.". 11 Areas for hunting Sambar Deer with the use of hounds (1) In regulation 72(1) of the Principal Regulations omit "other than within the permitted hunting area". (2) For regulation 72(2) of the Principal Regulations substitute— "(2) Subregulation (1) does not apply to a person who hunts or takes Sambar Deer with the use of hounds or destroys Sambar Deer— (a) within the permitted hunting area; or (b) other than within the permitted hunting area, if the person has written authorisation given by the Secretary to do so; or (c) within the area shown by shading on the plan in Part 3 or 4 of the Schedule 10 if the person— (i) is an owner or occupier of private land when doing so on that private land; or (ii) has permission given by the owner or occupier of private land, when doing so on that private land.". r. 10 -- 4 of 8 -- S.R. No. 161/2012 Wildlife (Game) Amendment Regulations 2012 4 Authorised by the Chief Parliamentary Counsel 12 Schedule 9 For the plan in Part 4 of Schedule 9 to the Principal Regulations substitute— " ". r. 12 -- 5 of 8 -- S.R. No. 161/2012 Wildlife (Game) Amendment Regulations 2012 5 Authorised by the Chief Parliamentary Counsel 13 Schedule 10 (1) In the heading to Schedule 10 to the Principal Regulations omit "AREAS FOR". (2) For the plan in Part 3 of Schedule 10 to the Principal Regulations substitute— " ". r. 13 -- 6 of 8 -- S.R.
