No. 128/2011 Climate Change Act 2010 Climate Change Regulations 2011 The Governor in Council makes the following Regulations: Dated: 15 November 2011 Responsible Minister: RYAN SMITH Minister for Environment and Climate Change MATTHEW McBEATH Clerk of the Executive Council PART 1—PRELIMINARY 1 Objectives The objectives of these Regulations are to prescribe— (a) the method for calculating the amount of Victoria's greenhouse gas emissions for the year 2000; and (b) the method for calculating any reduction in the amount of Victoria's greenhouse gas emissions; and (c) the information to be recorded in the Register of Carbon Sequestration Agreements. 2 Authorising provision These Regulations are made under section 64 of the Climate Change Act 2010. -- 2 of 8 -- Part 1—Preliminary Climate Change Regulations 2011 S.R. No. 128/2011 2 Authorised by the Chief Parliamentary Counsel 3 Definition In these Regulations— the Act means the Climate Change Act 2010. __________________ r. 3 -- 3 of 8 -- Part 2—Greenhouse Gas Emissions Target Climate Change Regulations 2011 S.R. No. 128/2011 3 Authorised by the Chief Parliamentary Counsel PART 2—GREENHOUSE GAS EMISSIONS TARGET 4 Calculating the amount of Victoria's greenhouse gas emissions for the year 2000 For the purposes of section 5(2) of the Act, the figure that represents the amount of Victoria's greenhouse gas emissions for the year 2000 is to be determined by adding the total carbon dioxide equivalent emission figures for Victoria for each of the following sectors— (a) energy; (b) industrial processes; (c) solvent and other product use; (d) agriculture; (e) land use, land use change and forestry; (f) waste; (g) other sectors— as set out in Australia's National Greenhouse Gas Accounts: State and Territory Greenhouse Gas Inventories as published by the Commonwealth and issued or published from time to time. 5 Calculating any reduction in the amount of Victoria's greenhouse gas emissions Any reduction in the amount of Victoria's greenhouse gas emissions for a year subsequent to the year 2000 is to be calculated using the formula— A – B where— A is the amount of Victoria's greenhouse gas emissions for the year 2000 determined in accordance with section 5(2) of the Act; and r. 4 -- 4 of 8 -- Part 2—Greenhouse Gas Emissions Target Climate Change Regulations 2011 S.R. No. 128/2011 4 Authorised by the Chief Parliamentary Counsel B is the sum of the carbon dioxide equivalent emission figures for Victoria for that year for each of the following sectors— (a) energy; (b) industrial processes; (c) solvent and other product use; (d) agriculture; (e) land use, land use change and forestry; (f) waste; (g) other sectors— as set out in Australia's National Greenhouse Gas Accounts: State and Territory Greenhouse Gas Inventories as published by the Commonwealth and issued or published from time to time. __________________ r. 5 -- 5 of 8 -- Part 3—Register of Carbon Sequestration Agreements Climate Change Regulations 2011 S.R. No. 128/2011 5 Authorised by the Chief Parliamentary Counsel PART 3—REGISTER OF CARBON SEQUESTRATION AGREEMENTS 6 Register of Carbon Sequestration Agreements to be maintained by the Secretary (1) The Register of Carbon Sequestration Agreements maintained by the Secretary must include, in relation to each Carbon Sequestration Agreement— (a) the names of the parties to the agreement; and (b) the description of the land to which the agreement applies; and (c) the date on which agreement was made; and (d) the effective date of the agreement; and (e) the term of the agreement; and (f) if the agreement is varied, the date on which it was varied; and (g) the effective date of the ending of the agreement. (2) The Secretary— (a) must ensure that the Register of Carbon Sequestration Agreements is available for inspection at the principal office of the Department; and (b) must cause a copy of the Register of Carbon Sequestration Agreements to be available on the Department's website; and (c) must cause a copy of each Carbon Sequestration Agreement made and varied to be available for inspection at the principal office of the Department; and r. 6 -- 6 of 8 -- Part 3—Register of Carbon Sequestration Agreements Climate Change Regulations 2011 S.R. No. 128/2011 6 Authorised by the Chief Parliamentary Counsel (d) must cause a copy of each Carbon Sequestration Agreement made and varied to be available on the Department's website. 7 Corrections and amendment of the Register of Carbon Sequestration Agreements (1) The Secretary, if satisfied that it is necessary to do so to reflect the current status of a record or information, may— (a) correct any error in a recording; or (b) amend any recording; or (c) delete or cancel any recording. (2) The Secretary may correct or amend the Register of Carbon Sequestration Agreements by— (a) adding, cancelling or deleting a recording; or (b) adding, altering or deleting particulars or details contained in a recording. 8 Removal from the Register of Carbon Sequestration Agreements The Secretary may remove from the Department's website a Carbon Sequestration Agreement after that agreement has ended. ═══════════════ r. 7 -- 7 of 8 -- Climate Change Regulations 2011 S.R.
