No. 138/2011 Gambling Regulation Act 2003 Gambling Regulation (Pre-commitment) Interim Regulations 2011 The Governor in Council makes the following Regulations: Dated: 29 November 2011 Responsible Minister: MICHAEL O'BRIEN Minister for Gaming MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is— (a) to prescribe certain mechanisms as pre-commitment mechanisms that are to apply to prescribed gaming machines referred to in section 3.4.31A of the Gambling Regulation Act 2003; and (b) to prescribe, for the purposes of that section, certain gaming machines as prescribed gaming machines. 2 Authorising provision These Regulations are made under section 11.2.1 of the Gambling Regulation Act 2003. 3 Commencement These Regulations come into operation on 2 December 2011. -- 2 of 7 -- S.R. No. 138/2011 Gambling Regulation (Pre-commitment) Interim Regulations 2011 2 Authorised by the Chief Parliamentary Counsel 4 Definitions In these Regulations— communication protocol means the component, whether computer hardware or software, of a gaming machine type approved by the Commission under section 3.5.4(3) of the Act that is used for the purpose of transmitting data between a gaming machine and an electronic monitoring system; pre-commitment session means the period between the time when a player sets a time limit or net loss limit on a gaming machine and the time when that player exceeds that limit; the Act means Gambling Regulation Act 2003. 5 Required pre-commitment mechanism For the purposes of the definition of pre-commitment mechanism in section 1.3(1) of the Act, a mechanism that does the following is prescribed and applies to a prescribed gaming machine referred to in section 3.4.31A of the Act— (a) allows a person to set a time limit or net loss limit before the person plays the gaming machine; and (b) if the time limit is exceeded, causes the following information to be displayed immediately on the screen of the gaming machine for at least 15 seconds— (i) cash in, being the total amount (expressed in dollars and cents) the player has put into the gaming machine during the pre-commitment session; r. 4 -- 3 of 7 -- S.R. No. 138/2011 Gambling Regulation (Pre-commitment) Interim Regulations 2011 3 Authorised by the Chief Parliamentary Counsel (ii) credits played, being the amount (expressed in dollars and cents) wagered by the player on the gaming machine during the pre-commitment session; (iii) credits won, being the amount (expressed in dollars and cents) won by the player on the gaming machine during the pre-commitment session; (iv) the net win or net loss (expressed in dollars and cents) of the player during the pre-commitment session; (v) credits available, being the amount (expressed in dollars and cents) that is currently available for the player to wager on the gaming machine; (vi) the time the player began the pre-commitment session; (vii) the current time of day; (viii) the duration of the pre-commitment session (expressed in hours and minutes); (ix) a statement that if the player does not wish to continue with their play the player can obtain any remaining credits on that gaming machine by pressing the Collect button; and (c) if the net loss limit is exceeded, causes the following information to be displayed immediately on the screen of the gaming machine for at least 15 seconds— r. 5 -- 4 of 7 -- S.R. No. 138/2011 Gambling Regulation (Pre-commitment) Interim Regulations 2011 4 Authorised by the Chief Parliamentary Counsel (i) cash in, being the total amount (expressed in dollars and cents) the player has put into the gaming machine during the pre-commitment session; (ii) credits played, being the amount (expressed in dollars and cents) wagered by the player on the gaming machine during the pre-commitment session; (iii) credits won, being the amount (expressed in dollars and cents) won by the player on the gaming machine during the pre-commitment session; (iv) the net loss (expressed in dollars and cents) the player has incurred during the pre-commitment session; (v) credits available, being the amount (expressed in dollars and cents) that is currently available for the player to wager on the gaming machine; (vi) the time the player began the pre-commitment session; (vii) the current time of day; (viii) the duration of the pre-commitment session (expressed in hours and minutes); (ix) a statement that if the player does not wish to continue with their play the player can obtain any remaining credits on that gaming machine by pressing the Collect button. r. 5 -- 5 of 7 -- S.R. No. 138/2011 Gambling Regulation (Pre-commitment) Interim Regulations 2011 5 Authorised by the Chief Parliamentary Counsel Examples 1 The following is an example of the information that may be displayed if a player sets a time limit of 30 minutes and exceeds that time limit: Cash in $25.00 Credits played $34.50 Credits won $32.50 Net Win or (Net Loss) ($2.00) Credits available $23.00 Time commenced 10:22 a.m. Current time 10.53 a.m. Total time played 31 minutes. 2 The following is an example of the information that may be displayed if a player sets a net loss limit of $30 and exceeds that net loss limit: Cash in $50.00 Credits played $100.20 Credits won $70.10 (Net Loss) ($30.10) Credits available $19.90 Time commenced 8:35 p.m. Current time 9:58 p.m. Total time played 1 hour and 23 minutes. 6 Gaming machines required to have a pre-commitment mechanism (1) Subject to subregulation (2), for the purposes of section 3.4.31A of the Act, a prescribed gaming machine is a gaming machine type approved by the Commission under section 3.5.4(3) of the Act on or after 1 December 2010. r. 6 -- 6 of 7 -- S.R. No. 138/2011 Gambling Regulation (Pre-commitment) Interim Regulations 2011 6 Authorised by the Chief Parliamentary Counsel (2) If a gaming machine type approved by the Commission under section 3.5.4(3) of the Act on or after 1 December 2010 is the same gaming machine type, except for its communication protocol, that has been approved by the Commission under that section before 1 December 2010, then the gaming machine type is not a prescribed gaming machine. 7 Expiry These Regulations expire on 1 December 2012. ═══════════════ r. 7 -- 7 of 7 --
