No. 69/2011 Juries Act 2000 Juries (Fees) Interim Regulations 2011 The Governor in Council makes the following Regulations: Dated: 26 July 2011 Responsible Minister: ROBERT CLARK Attorney-General MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe fees payable by a party requiring a civil case to be tried by a jury in the Supreme Court or the County Court. 2 Authorising provision These Regulations are made under section 90 of the Juries Act 2000. 3 Commencement These Regulations come into operation on 30 July 2011. 4 Revocation The following Regulations are revoked— (a) the Juries (Fees, Remuneration and Allowances) Regulations 2001 1 ; -- 2 of 4 -- S.R. No. 69/2011 Juries (Fees) Interim Regulations 2011 2 Authorised by the Chief Parliamentary Counsel (b) the Juries (Fees, Remuneration and Allowances) (Amendment) Regulations 20032 . 5 Fees for civil juries For the purposes of section 24(1) and (2) of the Juries Act 2000, the prescribed fees are as follows— (a) on setting a proceeding down for trial by a jury in the Supreme Court or the County Court—46⋅9 fee units; and (b) for each day after the first day of a trial not exceeding 6 days—5⋅7 fee units for each member of the jury; and (c) for each day of a trial in excess of 6 days— 11⋅3 fee units for each member of the jury. 6 Administrative expenses in respect of refund of fees For the purposes of section 24(7) of the Juries Act 2000, the prescribed fee is 4⋅6 fee units. 7 Expiry These Regulations expire on 29 July 2012. ═══════════════ r. 5 -- 3 of 4 -- S.R. No. 88/2004. 2 Reg. 4(b): S.R. No. 57/2003. —— Fee Units These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004. The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit. The value of a fee unit for the financial year commencing 1 July 2011 is $12.22. The amount of the calculated fee may be rounded to the nearest 10 cents. The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year. Endnotes -- 4 of 4 --
