Magistrates' Court (Arbitration) (Professional
Costs) Amendment Regulations 2011
The Lieutenant-Governor as the Governor's deputy with the
advice of the Executive Council makes the following
Regulations:

1 Objective
The objective of these Regulations is to amend the
Magistrates' Court (Arbitration) Regulations
2010—
(a) to increase the allowances for professional
costs which may be awarded to a party in
respect of an arbitration under Division 2 of
Part 5 of the Magistrates' Court Act 1989;
and
(b) as a consequence of the commencement of
the Magistrates' Court General Civil
Procedure Rules 2010.
2 Authorising provision
These Regulations are made under section 140 of
the Magistrates' Court Act 1989.

3 Commencement
These Regulations come into operation on
12 September 2011.
4 Amendments to Schedule 3
In clause 1 of Schedule 3 to the Magistrates' Court
(Arbitration) Regulations 20101 —
(a) in paragraphs (a) and (c), for "$1243"
substitute "$1307";
(b) in paragraphs (b) and (d), for "$1340"
substitute "$1409";
(c) in paragraphs (e) and (f), for "$1437"
substitute "$1511";
(d) in paragraph (g)—
(i) in subparagraph (i), for "$234"
substitute "$246";
(ii) in subparagraph (ii), for "$291"
substitute "$306";
(iii) in subparagraph (iii), for "$350"
substitute "$368";
(e) for "Magistrates' Court Civil Procedure
Rules 2009" substitute "Magistrates' Court
General Civil Procedure Rules 2010".
