1 Fair Work Act 2009 s.394—Unfair dismissal Annie Geng v Westpac Banking Corporation (U2024/5849) COMMISSIONER P RYAN SYDNEY, 20 FEBRUARY 2026 Application for an unfair dismissal remedy [1] Annie Geng has made an application to the Fair Work Commission under s.394 of the Fair Work Act 2009 (Cth) alleging that she was unfairly dismissed from her employment with the Westpac Banking Corporation (Westpac). [2] I have determined that there was a valid reason for Ms Geng’s dismissal and that she was not unfairly dismissed. In coming to this conclusion, I have found that Ms Geng engaged in conduct that was in breach of Westpac’s Code of Conduct, Conflicts of Interest Policy, Privacy Policy and Technology Code of Use Policy. [3] I have provided reasons for my findings in a Confidential Decision issued to the parties contemporaneously with this Decision. The Confidential Decision and other information relating to Ms Geng is subject to a Confidentiality Order (PR781732). [4] I order that Ms Geng’s application be dismissed.
