1 Fair Work Act 2009 s.394 - Application for unfair dismissal remedy Angel Semaan v Jim's Group Pty Ltd (U2026/42) DEPUTY PRESIDENT O'NEILL ADELAIDE, 24 APRIL 2026 Application for an unfair dismissal remedy – dismissal under s.587(1)(a) at the Commission’s initiative. [1] On 1 January 2026, Ms Angel Semaan made an unfair dismissal application under s.394 of the Fair Work Act 2009 (Cth). [2] For the reasons that follow, I am satisfied that Ms Semaan’s application has not been made in accordance with the Act and that it is appropriate to dismiss the application. [3] Ms Semaan’s application was incomplete because she did not pay the required fee or file a completed request to waive the fee. [4] Commission staff attempted to contact Ms Semaan on 10 January 2026 by email and SMS. [5] On 10 April 2026, Ms Semaan was advised that her application remained unpaid and waiver remained incomplete, and if she does not contact the Commission by 17 April 2026, her application may be dismissed under s.587(1)(a) because it has not been made in accordance with the Act. [6] Ms Semaan has not responded to the Commission’s multiple attempts to contact her, nor has she paid the applicable fee or submitted a complete waiver request. [7] Ms Semaan has been given ample opportunity to rectify the deficiency in the application and has not responded to multiple enquiries and warnings that her application may be dismissed. [8] I am satisfied that Ms Semaan’s application should be dismissed. I make the following order: 1. The application under section 394 of the Fair Work Act 2009 (Cth) made by Angel Semaan on 1 January 2026 is dismissed.
