No. 70/2010 Electronic Transactions (Victoria) Act 2000 Electronic Transactions (Victoria) Regulations 2010 The Governor in Council makes the following Regulations: Dated: 27 July 2010 Responsible Minister: ROB HULLS Attorney-General MATTHEW McBEATH Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to provide exemptions from the application of the Electronic Transactions (Victoria) Act 2000. 2 Authorising provision These Regulations are made under section 15 of the Electronic Transactions (Victoria) Act 2000. 3 Commencement These Regulations come into operation on 28 August 2010. 4 Revocation The Electronic Transactions (Victoria) Regulations 2000 1 are revoked. -- 2 of 4 -- S.R. No. 70/2010 Electronic Transactions (Victoria) Regulations 2010 2 5 Definition In these Regulations, the Act means the Electronic Transactions (Victoria) Act 2000. 6 Exemption for wills, codicils and other testamentary instruments (1) Section 7(1) of the Act does not apply to any transaction whereby a will, a codicil or any other testamentary instrument is created, executed or revoked. (2) Division 2 of Part 2 of the Act does not apply to a requirement or permission relating to the creation, execution or revocation of a will, a codicil or any other testamentary instrument. 7 Exemption for personal service requirements (1) Section 7(1) of the Act does not apply to any transaction (being the delivery of information or a document) required to be effected only by personal service. (2) Division 2 of Part 2 of the Act does not apply to a requirement that information or a document be delivered only by personal service. ═══════════════ r. 5 -- 3 of 4 -- S.R.
