No. 138/2010 First Home Owner Grant Act 2000 First Home Owner Grant Amendment Regulations 2010 The Governor in Council makes the following Regulations: Dated: 26 October 2010 Responsible Minister: JOHN LENDERS Treasurer MATTHEW McBEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the First Home Owner Grant Regulations 2001 to authorise the disclosure of protected information to a member of the New Zealand police force for the purposes of section 50 of the First Home Owner Grant Act 2000. 2 Authorising provision These Regulations are made under section 54 of the First Home Owner Grant Act 2000. 3 Principal Regulations In these regulations, the First Home Owner Grant Regulations 2001 1 are called the Principal Regulations. -- 2 of 5 -- S.R. No. 138/2010 First Home Owner Grant Amendment Regulations 2010 2 4 New regulation 1 substituted For regulation 1 of the Principal Regulations substitute— "1 Objective The objectives of these Regulations are— (a) to provide that a certain interest is recognised as a relevant interest in land for the purposes of section 5(4) of the First Home Owner Grant Act 2000; and (b) to authorise the disclosure of protected information to a member of the New Zealand police force for the purposes of section 50 of the First Home Owner Grant Act 2000.". 5 Definitions (1) In regulation 3 of the Principal Regulations, for "2000." substitute "2000;" (2) In regulation 3 of the Principal Regulations insert the following definition— "member of the New Zealand police force means a person who is a Police employee within the meaning of the Policing Act 2008 of New Zealand.". 6 New regulation 6 inserted After regulation 5 of the Principal Regulations insert— "6 Authorised disclosure of protected information For the purposes of section 50(4)(d) of the First Home Owner Grant Act 2000, protected information is authorised to be disclosed to a member of the New Zealand r. 4 -- 3 of 5 -- S.R.
