No. 149/2010 Liquor Control Reform Act 1998 Liquor Control Reform Amendment (Fees) Regulations 2010 The Governor in Council makes the following Regulations: Dated: 20 December 2010 Responsible Minister: MICHAEL O'BRIEN Minister for Consumer Affairs MATTHEW McBEATH Clerk of the Executive Council PART 1—PRELIMINARY 1 Objective The objective of these Regulations is to amend— (a) the Liquor Control Reform Regulations 2009 to reduce fees for certain categories of liquor licences; and (b) the Liquor Control Reform Amendment Regulations 2010 to revoke the Director's power to reduce renewal fees for restricted club licences and renewable limited licences in certain circumstances in 2011. 2 Authorising provision These Regulations are made under section 180 of the Liquor Control Reform Act 1998. 1 -- 2 of 7 -- Part 1—Preliminary Liquor Control Reform Amendment (Fees) Regulations 2010 S.R. No. 149/2010 2 3 Commencement (1) These Regulations, other than Part 2, come into operation on 31 December 2010. (2) Part 2 comes into operation on 1 January 2011. __________________ r. 3 -- 3 of 7 -- Part 2—Amendments to the Liquor Control Reform Regulations 2009 Liquor Control Reform Amendment (Fees) Regulations 2010 S.R. No. 149/2010 3 PART 2—AMENDMENTS TO THE LIQUOR CONTROL REFORM REGULATIONS 2009 4 Base fees (1) For regulation 24 of the Liquor Control Reform Regulations 20091 substitute— "24 Base fees (1) The base fee for the following licences and BYO permits is 16·74 fee units— (a) restaurant and cafe licence; (b) vigneron's licence; (c) restricted club licence; (d) renewable limited licence; (e) BYO permit. (2) Subject to subregulation (5), the base fee for the following licences is 68·01 fee units— (a) late night (general) licence; (b) late night (on-premises) licence; (c) general licence; (d) on-premises licence; (e) pre-retail licence. (3) Subject to subregulation (5), the base fee for a full club licence is— (a) in the case of a club where gaming machines are on the licensed premises—68·01 fee units; (b) in any other case—33·47 fee units. r. 4 -- 4 of 7 -- Part 2—Amendments to the Liquor Control Reform Regulations 2009 Liquor Control Reform Amendment (Fees) Regulations 2010 S.R. No. 149/2010 4 (4) The base fee for the following licences is 136·01 fee units— (a) late night (packaged liquor) licence; (b) packaged liquor licence. (5) This regulation does not apply to a licence on which a condition is specified in relation to the provision of sexually explicit entertainment. (6) In this regulation, gaming machine has the same meaning as in the Gambling Regulation Act 2003.". 5 Amendment to Schedule 1 In Schedule 1 to the Liquor Control Reform Regulations 2009, for— "28(1)(c)(ii) Fee for temporary limited licence 7·74 fee units" substitute— "28(1)(c)(ii) Fee for temporary limited licence where the applicant holds a licence or permit (other than a temporary limited licence or major event licence) 7·74 fee units 28(1)(c)(ii) Fee for temporary limited licence where the applicant does not hold a licence or permit (other than a temporary limited licence or major event licence) 4·18 fee units". __________________ r. 5 -- 5 of 7 -- Part 3—Amendments to the Liquor Control Reform Amendment Regulations 2010 Liquor Control Reform Amendment (Fees) Regulations 2010 S.R. No. 149/2010 5 r. 6 PART 3—AMENDMENTS TO THE LIQUOR CONTROL REFORM AMENDMENT REGULATIONS 2010 6 Commencement In regulation 3 of the Liquor Control Reform Amendment Regulations 20102— (a) in subregulation (1) omit ", 11"; (b) in subregulation (2), for "8, 9 and 11" substitute "8 and 9". 7 Regulation 11 revoked Regulation 11 of the Liquor Control Reform Amendment Regulations 2010 is revoked. ═══════════════ -- 6 of 7 -- Liquor Control Reform Amendment (Fees) Regulations 2010 S.R.
