No. 27/2010 Marine Act 1988 Marine Amendment Regulations 2010 The Governor in Council makes the following Regulations: Dated: 18 May 2010 Responsible Minister: TIM PALLAS Minister for Roads and Ports TOBY HALLIGAN Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Marine Regulations 2009 to— (a) delay the application of Part E of the National Standard for Commercial Vessels to trading and fishing vessels; and (b) amend the fee amounts for personal watercraft endorsements and record searches; and (c) insert an expiry date in those regulations; and (d) make technical amendments to Schedule 13 to those Regulations. 2 Authorising provisions These Regulations are made under sections 105 and 108 of the Marine Act 1988. -- 2 of 6 -- S.R. No. 27/2010 Marine Amendment Regulations 2010 2 3 Principal Regulations In these Regulations, the Marine Regulations 2009 1 are called the Principal Regulations. 4 Amendment of objectives In regulation 100 of the Principal Regulations, after paragraph (g) insert— "(ga) to provide for the expiry of these Regulations on 21 December 2012;". 5 Trading and fishing vessels—construction and equipment In regulation 212(2) of the Principal Regulations before "Part E" insert "On and from 1 July 2011". 6 Fee for operator licence and personal watercraft endorsement (1) In column 3 of item 3 of the Table in regulation 830 of the Principal Regulations, for "$52.50" substitute "$5.10". (2) In column 3 of item 4 of the Table in regulation 830 of the Principal Regulations, for "$25.70" substitute "$2.50". 7 Fee for search of records of operator licences In regulation 832 of the Principal Regulations, for "$67.75" substitute "$6.60". r. 3 -- 3 of 6 -- S.R. No. 27/2010 Marine Amendment Regulations 2010 3 8 New Part 12 inserted After Part 11 of the Principal Regulations, insert— "__________________ PART 12—EXPIRY 1200 Expiry These Regulations expire and cease to have effect on 21 December 2012.". 9 Amendment of Schedule 13 (1) In column 3 of Schedule 13 to the Principal Regulations, for "MA s. 20(1)" substitute "An offence under s. 20(2) of the MA constituted by a contravention of s. 20(1) of the MA". (2) In column 1 of Schedule 13 to the Principal Regulations, for "5776" substitute "2340". (3) In column 1 of Schedule 13 to the Principal Regulations, for "5777" substitute "5776".
