Regulations 2010
The Governor in Council makes the following Regulations:

1 Objectives
The objectives of these Regulations are to amend
the Road Safety (Vehicles) Regulations 2009 to—
(a) facilitate the identification of certain
passenger cars that are powered solely by
electricity; and
(b) reduce the registration fees payable in
respect of hybrid vehicles and certain
passenger cars that are powered solely by
electricity; and
(c) replace certain references to the Transport
Act 1983 with references to the Transport
(Compliance and Miscellaneous) Act 1983.
2 Authorising provision
These Regulations are made under section 95 of
the Road Safety Act 1986.

3 Principal Regulations
In these Regulations, the Road Safety (Vehicles)
Regulations 2009 1 are called the Principal
Regulations.
4 Definitions
In regulation 5 of the Principal Regulations
insert—
"electric powered passenger car means a vehicle
that is a passenger car (MA) equipped to
run solely on electricity and that is not a
vehicle referred to in item 7 of the Table to
Schedule 3;".
5 Registration numbers
In regulation 44(5)(b) of the Principal
Regulations, for "Transport Act 1983" substitute
"Transport (Compliance and Miscellaneous)
Act 1983".
6 New regulation 48B inserted
After regulation 48A of the Principal Regulations
insert—
"48B Electric powered passenger cars
An electric powered passenger car must have
fixed conspicuously to the front and rear
number plates a label that is—
(a) made of durable material; and
(b) at least 25 millimetres wide and
25 millimetres high; and
(c) mounted as a diamond; and
(d) reflective blue; and
(e) marked "EV" in capital letters at least
6 millimetres high.".

7 Fees for registration and renewal of registration of
other vehicles
(a) In regulation 102(2) of the Principal
Regulations, after "vehicle" insert "or an
electric powered passenger car".
(b) In regulation 102(2)(a) of the Principal
Regulations, for "$50" substitute "$100".
(c) In regulation 102(2)(b) of the Principal
Regulations, for "$50" substitute "$100".
(d) In the note to regulation 102(2) of the
Principal Rules, after "5." insert "An electric
powered passenger car is a vehicle that is a
passenger car (MA) equipped to run solely
on electricity and that is not a vehicle
referred to in item 7 of the Table to
Schedule 3—see regulation 5.".
8 Schedule 2—Definitions
In paragraph (b) of the definition of transport
enforcement vehicle in clause 3 of Schedule 2 to
the Principal Regulations, for "Transport Act
1983" substitute "Transport (Compliance and
Miscellaneous) Act 1983".
9 Schedule 3—Fees for registration and renewal of
registration
(1) In item 11(f) of the Table to Schedule 3 to the
Principal Regulations, for "Transport Act 1983"
substitute "Transport (Compliance and
Miscellaneous) Act 1983".
(2) In item 12(i) of the Table to Schedule 3 to the
Principal Regulations, for "Transport Act 1983"
substitute "Transport (Compliance and
Miscellaneous) Act 1983".
