No. 109/2010 Victorian Energy Efficiency Target Act 2007 Victorian Energy Efficiency Target Amendment (Assignment of Right) Regulations 2010 The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations: Dated: 12 October 2010 Responsible Minister: PETER BATCHELOR Minister for Energy and Resources MATTHEW McBEATH Clerk of the Executive Council 1 Objectives The objectives of these Regulations are to amend the Victorian Energy Efficiency Target Regulations 2008— (a) to prescribe, for the purpose of section 16(3)(a)(ii) of the Victorian Energy Efficiency Target Act 2007, the prescribed activity of removing from residential premises refrigerators or freezers manufactured before 1996 and in working order and destroying them in accordance with the criteria specified in Part A of Schedule 19 to the Regulations; and -- 2 of 5 -- S.R. No. 109/2010 Victorian Energy Efficiency Target Amendment (Assignment of Right) Regulations 2010 2 (b) to prescribe a manner for assigning the right to create a certificate in relation to that prescribed activity; and (c) to require accredited persons to keep written records, in accordance with ESC guidelines, of an assignment to them of a right to create a certificate made by oral notice in relation to that prescribed activity. 2 Authorising provision These Regulations are made under section 75 of the Victorian Energy Efficiency Target Act 2007. 3 Commencement These Regulations come into operation on 14 October 2010. 4 New regulations 6A and 6B inserted After regulation 6 of the Victorian Energy Efficiency Target Regulations 20081 insert— "6A Manner in which right to create a certificate may be assigned in certain cases For the purposes of section 16(3)(a)(ii) of the Act— (a) the prescribed activity set out in regulation 6(s) is prescribed; and (b) the manner in which an assignment for the purposes of section 16(1)(b) of the Act must be made in the case of that prescribed activity is by notice in writing or orally. r. 2 -- 3 of 5 -- S.R. No. 109/2010 Victorian Energy Efficiency Target Amendment (Assignment of Right) Regulations 2010 3 6B Record keeping in relation to assignments of rights made by oral notice An accredited person who holds an assignment of a right to create a certificate that has been made by oral notice must comply with those parts of the ESC guidelines that provide for record keeping requirements in relation to those kinds of notices.". ═══════════════ r. 4 -- 4 of 5 -- S.R.
