No. 102/2009 Crimes Act 1958 Crimes (Search Warrant) Amendment Regulations 2009 The Governor in Council makes the following Regulations: Dated: 1 September 2009 Responsible Minister: ROB HULLS Attorney-General TOBY HALLIGAN Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the form of search warrant in the Crimes (Search Warrant) Regulations 2004 as a consequence of changes to the power to issue a search warrant under section 465 of the Crimes Act 1958. 2 Authorising provision These Regulations are made under section 465(4) of the Crimes Act 1958. 3 Commencement These Regulations come into operation on 3 September 2009. 4 Principal Regulations In these Regulations, the Crimes (Search Warrant) Regulations 2004 1 are called the Principal Regulations. -- 2 of 4 -- S.R. No. 102/2009 Crimes (Search Warrant) Amendment Regulations 2009 2 5 Schedule amended (1) In the Schedule to the Principal Regulations, for the following words and expressions— "Place where search will be conducted for article, thing or material: (Set out full address of premises to be searched)" substitute— "* Place where search will be conducted for article, thing or material: (Set out full address of premises to be searched) * Vehicle located in a public place where search will be conducted for article, thing or material: (Set out identifying details of vehicle to be searched)". (2) In the Schedule to the Principal Regulations, for the following words and expressions— " - to break, enter and search any place named or described in this warrant for any article, thing or material of any kind described in this warrant;" substitute— "- to break, enter and search any *place/*specified vehicle located in a public place named or described in this warrant for any article, thing or material of any kind described in this warrant;". (3) In the Schedule to the Principal Regulations for the following words and expressions— "*Strike out if not applicable" substitute— "*Strike out words which are not applicable". ═══════════════ r. 5 -- 3 of 4 -- S.R.
