No. 167/2009 Gambling Regulation Act 2003 Gambling Regulation Amendment (Advertising) Regulations 2009 The Governor in Council makes the following Regulations: Dated: 8 December 2009 Responsible Minister: TONY ROBINSON Minister for Gaming TOBY HALLIGAN Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe, for the purposes of Chapter 3 of the Gambling Regulation Act 2003, terms and symbols that are exceptions to the prohibition on publishing gaming machine advertising by or on behalf of venue operators and casino operators. 2 Authorising provision These Regulations are made under section 11.2.1 of the Gambling Regulation Act 2003. 3 Commencement These Regulations come into operation on 1 January 2010. -- 2 of 6 -- S.R. No. 167/2009 Gambling Regulation Amendment (Advertising) Regulations 2009 2 4 Principal Regulations In these Regulations, the Gambling Regulation Regulations 2005 1 are called the Principal Regulations. 5 New Part 3A inserted After Part 3 of the Principal Regulations insert— "PART 3A—GAMING MACHINE ADVERTISING 43A Exception to gaming machine advertising prohibitions—venue operators (1) For the purposes of section 3.5.34AA(6)(c) of the Act, a term set out in Schedule 2A is a prescribed term in relation to section 3.5.34AA(1). (2) Subregulation (1) expires on 15 August 2012. 43B Exceptions to gaming machine advertising prohibitions—casino operators (1) For the purposes of section 3.5.34AA(6)(c) of the Act, a term set out in Schedule 2B is a prescribed term in relation to section 3.5.34AA(2). (2) For the purposes of section 3.5.34AA(6)(c) of the Act, a symbol, or a symbol that is similar to or a reasonable likeness to a symbol, set out in Schedule 2C is a prescribed symbol in relation to section 3.5.34AA(2). __________________". r. 4 -- 3 of 6 -- S.R.
