No. 9/2009 Gas Industry Act 2001 Gas Industry (MSO Rules) Regulations 2009 The Governor in Council makes the following Regulations: Dated: 18 February 2009 Responsible Minister: PETER BATCHELOR Minister for Energy and Resources RYAN HEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is— (a) to provide that certain provisions of the MSO Rules are civil penalty provisions; and (b) to prescribe the maximum pecuniary penalty that a court may determine is payable by a person who contravenes a civil penalty provision. 2 Authorising provision These Regulations are made under section 236 of the Gas Industry Act 2001. 3 Commencement These Regulations come into operation on 18 February 2009. -- 2 of 5 -- S.R. No. 9/2009 Gas Industry (MSO Rules) Regulations 2009 2 4 Revocation The Gas Industry (MSO Rules) Regulations 1999 1 are revoked. 5 Civil penalty provisions A provision of the MSO Rules set out in column 2 of an item in the Schedule is, for the purposes of those Rules, a civil penalty provision. 6 Pecuniary penalties The amount specified in column 3 of an item in the Schedule is the maximum pecuniary penalty that a court may determine is payable by a person who has contravened the provision specified in column 2 of that item. __________________ r. 4 -- 3 of 5 -- S.R.
