No. 156/2009 Major Crime (Investigative Powers) Act 2004 Major Crime (Investigative Powers) Amendment Regulations 2009 The Governor in Council makes the following Regulations: Dated: 8 December 2009 Responsible Minister: ROB HULLS Attorney-General TOBY HALLIGAN Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Major Crime (Investigative Powers) Regulations 2005 to be consistent with— (a) the Criminal Procedure Act 2009; and (b) recent amendments to the Major Crime (Investigative Powers) Act 2004. 2 Authorising provision These Regulations are made under section 70 of the Major Crime (Investigative Powers) Act 2004. 3 Commencement These Regulations come into operation on the day on which section 4 of the Major Crime Legislation Amendment Act 2009 comes into operation. -- 2 of 4 -- S.R. No. 156/2009 Major Crime (Investigative Powers) Amendment Regulations 2009 2 4 Principal Regulations In these Regulations, the Major Crime (Investigative Powers) Regulations 2005 1 are called the Principal Regulations. 5 Taking of evidence In regulation 8(d) of the Principal Regulations, for "appearing at" substitute "attending". 6 Notice of application to Magistrates' Court to determine legal professional privilege Regulation 9 of the Principal Regulations is revoked. 7 Records to be kept by Chief Commissioner In regulation 11(h) of the Principal Regulations— (a) after "to the Supreme Court" insert "or to the County Court"; (b) after "by the Supreme Court" (where twice occurring) insert "or the County Court". 8 Forms amended and revoked (1) In Form 2 of the Schedule of the Principal Regulations, for "appear" substitute "attend". (2) Form 7 of the Schedule of the Principal Regulations is revoked. ═══════════════ r. 4 -- 3 of 4 -- S.R.
